The Special Rapporteur was told that the six senior officers mentioned above were responsible for intelligence and security in East Timor and it was therefore their responsibility to take action to forestall the demonstration; they were punished because they were commanding the troops that participated in the incident, but had given no order to open fire on the demonstrators.
٥٣- وقيل للمقرر الخاص أن الضباط الستة المشار اليهم أعلاه كانوا مسؤولين عن الاستخبارات واﻷمن في تيمور الشرقية وكان من ضمن مسؤولياتهم اذن اتخاذ الاجراءات المناسبة لتدارك المظاهرة؛ وعوقبوا لانهم كانوا يقودون الجنود الذين شاركوا في الحادث ولكنهم لم يصدروا أوامر باطلاق النار على المتظاهرين.

As I noted in my previous report, according to article 3 of the overall Agreement (A/53/951-S/1999/513, annex I), the Government of Indonesia is responsible for maintaining peace and security in East Timor in order to ensure that the popular consultation is carried out in a fair and peaceful way in an atmosphere free of intimidation, violence or interference from any side.
٢٢ - كما أشــــرت في تقريـــــري السابق، فإن حكومة إندونيسيا، وفقا للمادة ٣ من الاتفاق العام )A/53/951-S/1999/513، المرفق اﻷول(، مسؤولة عن حفظ السلم واﻷمن في تيمور الشرقية بغية كفالة سير عملية استطلاع رأي الشعب بطريقة نزيهة وسلمية وفي جو يخلو من التخويف أو العنف أو التدخل من أي جانب.

5. Underlines the Government of Indonesia's continuing responsibility under the Agreements of 5 May 1999, taking into account the mandate of the multinational force set out in paragraph 3 above, to maintain peace and security in East Timor in the interim phase between the conclusion of the popular consultation and the start of the implementation of its result and to guarantee the security of the personnel and premises of UNAMET;
٥ - يشدد، آخذا في الاعتبار ولاية القوة المتعددة الجنسيات المحددة في الفقرة ٣ أعــلاه، على المسؤولية المتواصلة لحكومة إندونيسيا بموجب اتفاقات ٥ أيار/ مايو ١٩٩٩ عن حفظ السلم واﻷمن في تيمور الشرقية في المرحلة الانتقالية الفاصلة بين إجراء الاستطلاع الشعبي وبدء تنفيذ نتائجه ومسؤوليتها عن ضمان أمن موظفي بعثة اﻷمم المتحدة في تيمور الشرقية وأماكن العمل التابعة لها؛

64. Under annex I, article 3, and annex III, paragraph 1, of the Agreements signed on 5 May by Indonesia, Portugal and the Secretary-General (A/53/951-S/1999/513), the Government of Indonesia assumed responsibility for maintaining peace and security in East Timor in order to ensure that the popular consultation was carried out in a fair and peaceful way, and in an atmosphere free of intimidation, violence or interference from any side.
٦٤ - وبموجب المرفق اﻷول المادة ٣ والمرفق الثالث الفقرة ١ من الاتفاقات الموقعة في ٥ أيار/ مايو بين إندونيسيا والبرتغال واﻷمين العام لﻷمم المتحدة (A/53/951-S/1999/513)، تتحمل حكومة إندونيسيا مسؤولية حفظ السلام واﻷمن في تيمور الشرقية من أجل إجراء الاستطلاع لرأي الشعب بطريقة عادلة وسليمة، في جو خال من التخويف أو العنف أو التدخل من أي جانب.
