وينبغي أن يتولى التحقيق في ادعاءات التعذيب وغيره من ضروب إساءة المعاملة هيئة تحقيقات خارجية، تكون مستقلة عن من يورطهم الادعاء، على ألا تكون هناك أي صلات أو تبعية مؤسسية بين المحققين والجناة المزعومين().

وأوصت اللجنة ألمانيا بأن تفوض لهيئات مستقلة مهمة إجراء تحقيق عاجل وكامل في جميع ادعاءات التعذيب وإساءة المعاملة من جانب الشرطة، دون أن تكون هناك صلة مؤسسية أو تراتبية بين المحققين والجناة المزعومين(83).
