In decision 12/CP.2, the COP adopted and thus brought into force the Memorandum of Understanding between the COP and the Council of the GEF, subsequent to the approval by the latter.
٧- وفي المقرر ٢١/م أ-٢، اعتمد مؤتمر اﻷطراف ومن ثم وضَع موضع التنفيذ مذكرة التفاهم بين مؤتمر اﻷطراف ومجلس مرفق البيئة العالمية في أعقاب موافقة هذا اﻷخير عليها.

In that note the secretariat outlined the provisions of the annex to the MOU between the COP and the Council of the GEF on the determination of funding necessary and available for the implementation of the Convention as brought into effect by decision 12/CP.3.

A memorandum of understanding (MOU) was concluded in 1996 between the Conference of the Parties (COP) and the Council of the GEF (decision 12/CP.2).
ووُقعت في عام 1996 مذكرة تفاهم بين مؤتمر الأطراف ومجلس مرفق البيئة العالمية (المقرر 12/م أ-2)().

13. This Memorandum of Understanding may only be modified in writing by agreement between the COP and the Council of the GEF.
٣١- لا يجوز تعديل مذكرة التفاهم هذه إلا كتابة باتفاق بين مؤتمر اﻷطراف ومجلس المرفق.

The MOU between the COP and the Council of the GEF further provides that the Conference of the Parties will, after each of its sessions, communicate to the GEF any policy guidance approved by the COP concerning the financial mechanism.
٠٦- كما تنص مذكرة التفاهم بين مؤتمر اﻷطراف ومجلس مرفق البيئة العالمية على أن يقوم مؤتمر اﻷطراف، بعد كل دورة من دوراته، بإبلاغ مرفق البيئة العالمية بأي توجيهات تتعلق بالسياسة العامة يقرها المؤتمر بشأن اﻵلية المالية.

Following consultations between the secretariats of the Convention and the GEF, a draft Memorandum of Understanding was prepared for consideration by the SBI and the Council of the GEF (see FCCC/SBI/1995/3).
٢ - وإثر مشاورات جرت بين أمانة الاتفاقية وأمانة مرفق البيئة العالمية تم إعداد مشروع مذكرة تفاهم لتنظر فيه الهيئة الفرعية للتنفيذ ومجلس مرفق البيئة العالمية )انظر (FCCC/SBI/1995/3.

The text of a draft Memorandum of Understanding (MOU) between the CMP and the Council of the GEF regarding secretariat services to the Adaptation Fund Board is presented in the appendix.
3- ويُعرَض في التذييل نص مشروع مذكرة تفاهم بين مؤتمر الأطراف/اجتماع الأطراف ومجلس مرفق البيئة العالمية بشأن خدمات الأمانة المقدمة لمجلس صندوق التكيف.

It provides that the arrangements described therein will become effective upon approval by the CMP and the Council of the GEF.
وتنص المذكرة على أن الترتيبات المشروحة فيها تُصبح سارية المفعول عند موافقة مؤتمر الأطراف/اجتماع الأطراف ومجلس مرفق البيئة العالمية عليها.

The MOU will be finalized upon mutual agreement by the CMP and the Council of the GEF.
5- وستُوضع المذكرة في صيغتها النهائية عندما يتم الاتفاق المتبادل عليها بين مؤتمر الأطراف/اجتماع الأطراف ومجلس مرفق البيئة العالمية.

This is to enable the COP to contribute, together with the Council of the GEF, to the joint determination of the amount of funding necessary and available for the implementation of the Convention, as defined in the MOU between the COP and the Council of the GEF.
وذلك لتمكين مؤتمر الأطراف من الإسهام مع مجلس مرفق البيئة العالمية في التحديد المشترك لمبلغ التمويل اللازم والمتاح لتنفيذ الاتفاقية، على النحو المحدد في مذكرة التفاهم بين مؤتمر الأطراف ومجلس مرفق البيئة العالمية.

23. As part of the assessment of the implementation of the Convention, the CRIC is also to review the information provided by the GEF in accordance with the memorandum of understanding between the COP and the Council of the GEF.
23- كجزء من تقييم تنفيذ الاتفاقية، يتعيّن أيضاً على لجنة استعراض تنفيذ الاتفاقية أن تستعرض المعلومات المقدمة من مرفق البيئة العالمية وفقاً لمذكرة التفاهم المعقودة بين مؤتمر الأطراف ومجلس مرفق البيئة العالمية.

The CMP and the Council of the GEF (hereinafter the Council) have reached the following understanding in accordance with the recommendation of the Board:
تَوصَّل مؤتمر الأطراف/اجتماع الأطراف ومجلس مرفق البيئة العالمية (يُشار إليه فيما بعد بعبارة " مجلس المرفق " ) إلى التفاهم التالي وفقاً لتوصية مجلس الصندوق:

It should be noted, in this connection, that the draft memorandum of understanding between the COP and the Council of the GEF, currently under consideration, does not deal in substance with the determination of funding necessary and available, in accordance with Article 11.3(d) of the Convention (FCCC/SBI/1995/3, para. 9).
وتجدر الملاحظة في هذا الصدد بأن مشروع مذكرة التفاهم بين مؤتمر اﻷطراف ومجلس مرفق البيئة العالمية الذي يجري النظر فيه حاليا لا يتناول موضوع تحديد التمويل اللازم والمتاح، وفقــا للمادة ١١-٣)د( مــن الاتفاقية FCCC/SBI/1995/3) ، الفقرة ٩(.

This report should be based on information and data identified in paragraph 1 (a) - (d) of the Annex to the Memorandum of Understanding between the COP and the Council of the GEF on the determination of funding necessary and available for the implementation of the Convention, in accordance with the guidance provided by the COP.
37- وينبغي أن يستند هذا التقرير إلى المعلومات والبيانات المحددة في الفقرة 1(أ) إلى (د) من مرفق مذكرة التفاهم بين مؤتمر الأطراف ومجلس مرفق البيئة العالمية بشأن تحديد التمويل اللازم والمتاح لتنفيذ الاتفاقية، وفقا لتوجيهات مؤتمر الأطراف.

The SBI decided to continue its consideration of the application of the memorandum of understanding between the COP and the Council of the GEF at its twenty-fourth session (May 2006), on the basis of the draft text contained in annex I to this report.
وقررت الهيئة الفرعية مواصلة النظر في تطبيق مذكرة التفاهم بين مؤتمر الأطراف ومجلس مرفق البيئة العالمية في دورتها الرابعة والعشرين (أيار/مايو 2006)، استناداً إلى مشروع النص الوارد في المرفق الأول بهذا التقرير.

The SBI further noted that inputs by the COP to fourth replenishment discussions should be consistent with the provisions of the Convention, and of the Annex to the Memorandum of Understanding between the COP and the Council of the GEF on the determination of funding necessary and available for the implementation of the Convention as brought into effect by decision 12/CP.3.
35- ولاحظت الهيئة الفرعية أيضا أن مساهمات مؤتمر الأطراف في المناقشات التي جرت بشأن العملية الرابعة لتجديد الموارد ينبغي أن تكون متسقة مع أحكام الاتفاقية، والمرفق بمذكرة التفاهم بين مؤتمر الأطراف ومجلس مرفق البيئة العالمية بشأن تحديد التمويل اللازم والمتاح لتنفيذ الاتفاقية على نحو ما نص عليه المقرر 12/م أ-3.

It also noted that inputs by the Conference of the Parties (COP) to fourth replenishment discussions should be consistent with the provisions of the Convention, and of the annex to the memorandum of understanding (MOU) between the COP and the Council of the GEF on the determination of funding necessary and available for the implementation of the Convention, as brought into effect by decision 12/CP.3.
ولاحظت الهيئة الفرعية أيضا أن مساهمات مؤتمر الأطراف في المناقشات التي جرت بشأن العملية الرابعة لتجديد الموارد ينبغي أن تكون متسقة مع أحكام الاتفاقية، والمرفق بمذكرة التفاهم بين مؤتمر الأطراف ومجلس مرفق البيئة العالمية بشأن تحديد التمويل اللازم والمتاح لتنفيذ الاتفاقية على نحو ما نص عليه المقرر 12/م أ-3.

14. This Memorandum of Understanding shall come into force upon its approval by the COP of the Convention and the Council of the GEF. Termination
٤١- يسري مفعول مذكرة التفاهم هذه بمجرد الموافقة عليها من جانب مؤتمر اﻷطراف في الاتفاقية ومجلس المرفق.

Pursuant to the Memorandum of Understanding between the COP and the Council of the GEF, the cooperation with the Stockholm Convention Secretariat that has been taking place since adoption of the Convention has continued. The Stockholm Convention Secretariat participates in all Council meetings and addressed the GEF Council a number of times.
