422. The Committee recommends that the State party envisage undertaking a comprehensive reform of the Juvenile Offender Act in the spirit of the Convention, in particular articles 37, 39 and 40, and of other United Nations standards in this field, such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of Their Liberty.
٤٢٢ - وتوصي اللجنة بأن تفكر الدولة الطرف في إجراء إصلاح شامل لقانون اﻷحداث الجانحين تمشيا مع روح الاتفاقية، وخاصة المواد ٣٧ و ٣٩ و ٤٠، ومع معايير اﻷمم المتحدة اﻷخرى في هذا الميدان، مثل " قواعد بكين " ، و " مبادئ الرياض التوجيهية " ، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

In this reform the State party should take fully into account the provisions of the Convention, in particular articles 37, 39 and 40, as well as other relevant international standards in this area, such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of Their Liberty.
وفي عملية الاصلاح القانوني تلك، ينبغي أن تأخذ الدولة الطرف بعين الاعتبار أحكام الاتفاقية، وخصوصا المواد ٧٣ و٩٣ و٠٤ وكذلك المعايير الدولية اﻷخرى ذات الصلة في هذا المجال، مثل قواعد بيجينغ، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة بشأن حماية اﻷحداث المجردين من حريتهم.

The advisory board is entrusted with the task of policy-making on juvenile institutions, rehabilitation programmes and legislation in the light of international instruments, including the Convention on the Rights of the Child, the Riyadh Guidelines, the Beijing Rules and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.

The Committee recommends that the law reform to be undertaken in this field adequately reflect the provisions of the Convention as well as other relevant international standards, such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.

The Committee recommends that the appropriate amendments be made to the Juveniles Act No. 31 of 1974 to adequately reflect the provisions of the Convention as well as other international standards in this field, such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
وتوصي اللجنة بادخال تعديلات مناسبة على قانون اﻷحداث رقم ٣١ لعام ١٩٧٤ بحيث يتم عكس أحكام الاتفاقية بصورة كافية وكذلك تعديل المعايير الدولية اﻷخرى في هذا الميدان، مثل قواعد بيجينغ، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

2. The United Nations Guidelines for the Prevention of Juvenile Delinquency, the United Nations Standard Minimum Rules for the Administration of Juvenile Justice and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty are applied, are provided for in current legislation and are thus widely known.
٢- وتطبﱠق في كوبا المبادئ التوجيهية لﻷمم المتحدة لمنع انحراف اﻷحداث، ومجموعة قواعد اﻷمم المتحدة الدنيا ﻹدارة شؤون قضاء اﻷحداث، وقواعد اﻷمم المتحدة بشأن حماية اﻷحداث المحرومين من حريتهم؛ وهذه اﻷحكام منصوص عليها في التشريعات السارية ومن ثم فهي معروفة على نطاق واسع لدى الجمهور.

48. The Committee is concerned about the compatibility of the juvenile justice system in the State party with articles 37, 40 and 39 of the Convention and with other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٨٤- واللجنة تجد مدعاة للقلق من حيث مدى تمشي قضاء اﻷحداث في الدولة الطرف مع المواد ٧٣ و٠٤ و٩٣ من الاتفاقية ومع المعايير اﻷخرى ذات الصلة مثل قواعد بيجين ومبادئ الرياض التوجيهية وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

63. The Committee recommends that the State party envisage undertaking further measures to ensure the full compatibility of the juvenile justice system with the Convention, especially articles 37, 40 and 39, and other United Nations standards in this field such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٣٦- وتوصي اللجنة بأن تتوخى الدولة الطرف اتخاذ مزيد من التدابير لضمان المواءمة التامة بين نظام قضاء اﻷحداث والاتفاقية، وخاصة المواد ٧٣ و٠٤ و٩٣، ومعايير اﻷمم المتحدة اﻷخرى في هذا الميدان مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

83. The administration of juvenile justice, and in particular its compatibility with articles 37, 40, and 39 of the Convention and with other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty, is a matter of concern to the Committee.
٣٨- ومن دواعي قلق اللجنة مسألة إدارة قضاء اﻷحداث، وعلى اﻷخص مدى تمشيها مع المواد ٧٣ و٠٤ و٩٣ من الاتفاقية ومع المعايير اﻷخرى ذات الصلة مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

125. While the Committee takes note that the administration of juvenile justice is regulated by the Juvenile Act, it is concerned about the full compatibility of this legislation with articles 37, 40 and 39 of the Convention as well as other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٥٢١- وإذ تعلم اللجنة بأن إدارة قضاء اﻷحداث ينظمها قانون اﻷحداث، فإنها تشعر بالقلق بصدد مطابقة التشريع المطابقة الكاملة للمواد ٧٣ و٠٤ و٩٣ من الاتفاقية فضلاً عن المعايير اﻷخرى مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

173. The situation in relation to the administration of juvenile justice and its compatibility with the principles and provisions of the Convention, in particular articles 37, 40 and 39, as well as other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty is a matter of concern to the Committee.
٣٧١- ومن القضايا التي تقلق اللجنة الوضع فيما يتعلق بإدارة شؤون قضاء اﻷحداث، ومدى تمشيها مع مبادئ الاتفاقية وأحكامها، ولا سيما المواد ٧٣ و٠٤ و٩٣ فضلاً عن المعايير اﻷخرى ذات الصلة مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

194. The Committee recommends that the State party envisage undertaking a review of the system of juvenile justice in light of the principles and provisions of the Convention and of other United Nations standards in this field such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٤٩١- وتوصي اللجنة الدولة الطرف بالنظر في مراجعة أوضاع نظام قضاء اﻷحداث على ضوء مبادئ الاتفاقية وأحكامها وغيرها من معايير اﻷمم المتحدة في هذا المجال، مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

263. The administration of juvenile justice, and in particular its compatibility with articles 37, 40 and 39 of the Convention and with other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty, is a matter of concern to the Committee.
٣٦٢- واللجنة تجد مدعاة للقلق في مسألة إدارة شؤون قضاء اﻷحداث، وخصوصاً تمشيها مع المواد ٧٣ و٠٤ و٩٣ من الاتفاقية، ومع غيرها من المعايير ذات الصلة، مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷطفال المحرومين من حريتهم.

55. With regard to the juvenile justice system in the State party, the Committee is concerned about its full compatibility with articles 37, 40 and 39 of the Convention and with other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٥٥- وتشعر اللجنة بالقلق إزاء حالة نظام قضاء اﻷحداث في الدولة الطرف لعدم انسجامه مع المواد ٧٣ و٩٣ و٠٤ من الاتفاقية وغيرها من المعايير ذات الصلة مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة بشأن حماية اﻷحداث المحرومين من حريتهم.

117. With regard to the juvenile justice system in the State party, the Committee is concerned about its lack of full compatibility with articles 37, 40 and 39 of the Convention and with other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٧١١- وفيما يتعلق بنظام قضاء اﻷحداث في الدولة الطرف، تشعر اللجنة بالقلق إزاء عدم التوافق التام لهذا النظام مع أحكام المواد ٧٣ و٠٤ و٩٣ من الاتفاقية ومع سائر المعايير ذات الصلة مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

The Committee also suggests that part of the training of law enforcement personnel, judges and other relevant personnel be devoted to an understanding of international standards on juvenile justice, including the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٢٦ - وتقترح اللجنة أيضا تخصيص جانب من تدريب الموظفين المكلفين بإنفاذ القوانين والقضاة وغيرهم من الموظفين المختصين لفهم المعايير الدولية الخاصة بقضاء اﻷحداث، بما في ذلك قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المجردين من حريتهم.

The Committee recommends that the State party envisage undertaking a comprehensive reform of the system of juvenile justice and that the Convention and other international standards in this field, such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty, be seen as a guide in this revision.
٧١١ - وتوصي اللجنة بأن تنظر الدولة الطرف في إجراء إصلاح شامل لقضاء اﻷحداث، وبأن تسترشد في هذا التعديل بالاتفاقية وبغيرها من المعايير الدولية المقررة في هذا الميدان، مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المجردين من حريتهم.

The Committee also recommends that a legal system of administration of juvenile justice be established in the light of the principles and provisions of the Convention, in particular articles 37 and 40, as well as other relevant United Nations standards, including the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٦٣١ - وتوصي اللجنة أيضا بإنشاء نظام قانوني ﻹدارة شؤون قضاء اﻷحداث في ضوء مبادئ الاتفاقية وأحكامها، وبخاصة المادتان ٧٣ و٠٤، وفي ضوء معايير اﻷمم المتحدة اﻷخرى ذات الصلة، بما في ذلك قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة بشأن حماية اﻷحداث المجردين من حريتهم.

The State party should also take measures to bring the conditions of detention in conformity with the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (The Beijing Rules), the United Nations Guidelines for the Prevention of Juvenile Delinquency (The Riyadh Guidelines) and the United Nations Rules for the Protection of Juveniles Deprived of Their Liberty.
وينبغي أيضاً أن تتخذ الدولة الطرف التدابير لجعل ظروف الاحتجاز متفقة مع قواعد الأمم المتحدة النموذجية الدنيا لإدارة شؤون قضاء الأحداث (قواعد بيجين)، ومبادئ الأمم المتحدة التوجيهية لمنع جنوح الأحداث (مبادئ الرياض التوجيهية) وقواعد الأمم المتحدة بشأن حماية الأحداث المجردين من حريتهم.
