States have an obligation to ensure equal access of men and women to the enjoyment of all rights, including by ensuring equality and non-discrimination in areas such as political rights, marriage and family, employment and health.

Ensuring the equal right of men and women to the enjoyment of all economic, social and cultural rights set forth in the Covenant

1. Article 3 of the Covenant requiring, as it does, States parties to ensure the equal right of men and women to the enjoyment of all civil and political rights provided for in the Covenant, has been insufficiently dealt with in a considerable number of States reports and has raised a number of concerns, two of which may be highlighted.
١- ان المادة ٣ من العهد، التي تطلب من الدول اﻷطراف أن تضمن حقوقا متساوية للرجال والنساء في التمتع بكافة الحقوق المدنية والسياسية المنصوص عليها في العهد، لم تحظ باهتمام كاف في عدد كبير من التقارير المقدمة من الدول، وقد أثارت عددا من الاهتمامات نركز النظر على اثنين منها.

The present domestic legislation, like all preceding constitutions, guarantees the equal right of men and women to the enjoyment of all civil and political rights.
والتشريع الوطني الحالي، شأنه شأن جميع الدساتير السابقة، يكفل تساوي حق الرجل والمرأة في التمتع بجميع الحقوق المدنية والسياسية.

It draws the attention of the State party to general comment No. 16 on the equal right of men and women to the enjoyment of all economic, social and cultural rights.

27. The INC provides for the " equal rights of men and women to the enjoyment of all civil and political rights.

The Committee stresses that prevailing social attitudes cannot justify failure by the State party to comply with its obligations under articles 3 and 26 of the Covenant to ensure equal protection of the law and the equal right of men and women to the enjoyment of all the rights set forth in the Covenant.
وتؤكد اللجنة أن المواقف الاجتمـاعية السائدة لا يمكن أن تبرر عدم امتثال الدولة الطرف لالتزاماتهـا بموجب المادتين 3 و26 من العهد بتأمين المساواة في حماية القانون وفي حق الرجل والمرأة في التمتع بجميع الحقوق المنصوص عليها في العهد.

It pays particular attention to the measures undertaken by States parties to ensure the equal right of men and women to the enjoyment of all economic, social and cultural rights set forth in articles 6 to 15 of the Covenant.
وتولي اللجنة اهتماما خاصا للتدابير التي تضطلع بها الدول اﻷطراف لكفالة تكافوء حق الرجل والمرأة في التمتع بجميع الحقوق الاقتصادية والاجتماعية والثقافية المنصوص عليها فى المواد ٦-٥١ من العهد.

657. At its twenty-eighth session, on 13 May 2002, the Committee held a day of general discussion on the equal right of men and women to the enjoyment of all economic, social and cultural rights (art. 3 of the Covenant).
657- خصصت اللجنة، خلال دورتها الثامنة والعشرين في 13 أيار/مايو 2002، يوماً للمناقشة العامة بشأن المساواة بين الرجل والمرأة في التمتع بجميع الحقوق الاقتصادية والاجتماعية والثقافية (المادة 3 من العهد).

In this regard, it draws the attention of the State party to its general comment No. 16 (2005) on the equal right of men and women to the enjoyment of all economic, social and cultural rights (art. 3).

Article 3 132. The Covenant, in article 3, provides that States parties undertake to ensure the equal right of men and women to the enjoyment of all civil and political rights set forth in the present Covenant.
132- ينص العهد، في المادة 3 منه، على وجوب تعهد الدول الأطراف فيه بكفالة تساوي الرجال والنساء في التمتع بجميع الحقوق المدنية والسياسية المنصوص عليها في هذا العهد.

The Committee reminds the State party that the equal right of men and women to the enjoyment of all economic, social and cultural rights is an immediate obligation of the States parties which cannot be conditioned to willingness of concerned communities to amend their laws.
تذكِّر اللجنة الدولة الطرف بأن المساواة بين الرجال والنساء في التمتع بجميع الحقوق الاقتصادية والاجتماعية والثقافية التزام فوري يقع على الدول الأطراف لا يمكن أن يكون مرهوناً برغبة المجموعات المعنية بتعديل قوانينها.

40. It is therefore crucial that the equal right of men and women to the enjoyment of all human rights, including those relevant to land, is protected and promoted.
