It was further noted that the second sentence, which relieved the shipper of all or part of its liability if it proved that the cause or one of the causes was not attributable to its fault or to the fault of any person referred to in draft article 34, was intended to apply regardless of which of the two variants was ultimately chosen.

Except in respect of loss or damage caused by a breach by the shipper of its obligations pursuant to articles 32, paragraph 2, and 33, the shipper is relieved of all or part of its liability if the cause or one of the causes of the loss or damage is not attributable to its fault or to the fault of any person referred to in article 35.
