It should be noted at the outset that by distinguishing between " any subsequent agreement " (article 31 (3) (a)) and " subsequent practice (...) which establishes the agreement of the parties " (article 31 (3) (b)), the Commission did not intend to denote a difference concerning their possible legal effect.
