In October 2012, the Office of the United Nations High Commissioner for Refugees (UNHCR) launched the Guidelines on the Applicable Criteria and Standards relating to the Detention of Asylum-Seekers and Alternatives to Detention, providing guidance on the necessity of detaining a particular individual, procedural safeguards, conditions of detention and alternatives to detention.

16. The detention of asylum seekers that does not comply with the requirements contained in UNHCR Revised Guidelines on Applicable Criteria and Standards Relating to the Detention of Asylum-Seekers is in principle arbitrary under international law.

23. The Working Group shares the reading of the criterion established in Guideline 2 of UNHCR Revised Guidelines on Applicable Criteria and Standards Relating to the Detention of Asylum-Seekers which reaffirms that, " [a]s to general principle asylum-seekers should not be detained. "

(b) Promote alternatives to detention and revise policy in order to bring it into line with the Guidelines on the Applicable Criteria and Standards relating to the Detention of Asylum Seekers and Alternatives to Detention published by the Office of the United Nations High Commissioner for Refugees;

(d) Use detention of asylum seekers only as a measure of last resort for as short a period as possible, refrain from detaining minors and revise policy in order to bring it in line with the Guidelines on the Applicable Criteria and Standards relating to the Detention of Asylum Seekers and Alternatives to Detention of the Office of the United Nations High Commissioner for Refugees.

In doing so, the Committee draws attention to the UNHCR Revised Guidelines on Applicable Criteria and Standards relating to the Detention of Asylum-Seekers (26 February 1999).

Similarly, in its resolution 2000/21, the Sub-Commission on the Promotion and Protection of Human Rights encouraged " States to adopt alternatives to detention such as those enumerated in the Guidelines on the Applicable Criteria and Standards relating to the Detention of Asylum Seekers " (para. 6).

In 2007, CAT noted with satisfaction, as highlighted also by UNHCR, the recent adoption of legislative measures to regulate the rights of persons staying at the Trandum Alien Holding Centre in accordance with the revised UNHCR Guidelines on Applicable Criteria and Standards for the Detention of Asylum Seekers.

In addition, the deprivation of freedom amounts to violations of the UNHCR Revised Guidelines on Applicable Criteria and Standards relating to the Detention of Asylum-Seekers and the Working Group on Arbitrary Detention's Deliberation No. 5 concerning the situation of immigrants and asylum seekers (E/CN.4/2000/4, annex II).
