Article 22, paragraph 5 (b), of the Convention precludes the Committee from considering any communication from an individual, unless it has ascertained that the individual has exhausted all available domestic remedies; this rule does not apply if it is established that the application of domestic remedies has been or would be unreasonable prolonged or would be unlikely to bring effective relief.

5.5 Lastly, the complainant maintains that in her case the rule of the exhaustion of domestic remedies does not apply since the application of domestic remedies is unreasonably prolonged, whereas judicial decisions are enforced immediately after the person concerned is notified of them.
5-5 وأخيرا تؤكد المشتكية أن قاعدة استنفاد سبل الانتصاف المحلية لا تنطبق عليها لأن إجراءات الانتصاف المحلية تستغرق وقتا يتجاوز المهل المعقولة في حين تُنفذ الأوامر القضائية مباشرة بعد إخطار الشخص المعني.

Consequently, the Committee is of the view that the application of domestic remedies has been unreasonably drawn out and that the author has therefore met the requirements of article 5, paragraph 2 (b), of the Optional Protocol.
