• تطبيق هذا البروتوكول

1. A Party to the Convention which intends to ratify, approve, accept or accede to this Protocol may at any time notify the Depositary that it will apply this Protocol provisionally for a period not exceeding two years.
1- يجوز لأي طرف في الاتفاقية يعتزم التصديق على هذا البروتوكول أو الموافقة عليه أو قبوله أو الانضمام إليه أن يخطر الوديع في أي وقت عن عزمه تطبيق هذا البروتوكول بصورة مؤقتة لمدة لا تزيد على سنتين.

Each signatory agrees to apply this Protocol provisionally pending its entry into force, to the extent that such provisional application is not inconsistent with its constitution, laws or regulations.
1- يوافق كل طرف موقِّع على تطبيق هذا البروتوكول تطبيقاً مؤقتاً ريثما يبدأ نفاذه، ما دام هذا التطبيق المؤقت لا يتعارض مع دستوره أو قوانينه أو أنظمته.

undertakes not to transfer any regulated cluster munition to States which are not bound by this Protocol unless the recipient State agrees to apply this Protocol [to the transferred munitions]; and
(د) يتعهد بعدم نقل أية ذخائر عنقودية منظم استخدامها إلى دول غير ملتزمة بهذا البروتوكول إلا إذا كانت الدولة المتلقية توافق على تطبيق هذا البروتوكول [على الذخائر المنقولة]؛ و

4. A High Contracting Party that has deferred the application of paragraph 1 shall, during the period of deferral, not transfer any cluster munition or submunition that does not meet the requirements of Article 4 (2), unless the recipient State agrees to apply this Protocol with respect to the transferred items.
4- يمتنع الطرف المتعاقد السامي الذي يؤجل تطبيق الفقرة 1، خلال فترة التأجيل، عن نقل أية ذخيرة عنقودية أو ذخيرة فرعية لا تستوفي شروط المادة 4(2)، إلا أن توافق الدولة المتلقية على تطبيق هذا البروتوكول فيما يتعلق بالمواد المنقولة.

4. A High Contracting Party that has deferred the application of paragraph 1 shall, during the period of deferral, not transfer any cluster munition or submunition that does not meet the requirements of Article 4 (2), unless the recipient State agrees to apply this Protocol with respect to the transferred items.
4- يمتنع الطرف المتعاقد السامي الذي يؤجل تطبيق الفقرة 1، خلال فترة التأجيل، عن نقل أية ذخيرة عنقودية أو ذخيرة فرعية لا تستوفي شروط المادة 4(2)، إلا إذا وافقت الدولة المتلقية على تطبيق هذا البروتوكول فيما يتعلق بالمواد المنقولة.
