On 9 November 1999, the Committee communicated its views concerning communication No. 63/1997 submitted by the complainant, Josu Arkauz Arana against France (see paragraph 3.5.5);

107. In its assessment of Josu Arkauz Arana v. France, the Committee against Torture stressed the importance of giving the individual expelled the possibility to contact his or her family or lawyer in order to avoid possible abuse, which may give rise to a violation of article 3 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
107 - ورأت لجنة مناهضة التعذيب، حين النظر في قضية خوسو أركاوث أرانا ضد فرنسا، أن من المهم منح الفرد المطرود إمكانية الاتصال بأسرته أو محاميه لتجنب الإساءات المحتملة التي يمكن أن تشكل انتهاكا للمادة 3 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة.

The Committee, therefore, considers that, unlike in the case of Josu Arkauz Arana, the legal guarantees were sufficient, in the complainant's case, to avoid placing her in a situation where she was particularly vulnerable to possible abuse by the Spanish authorities.
