Paragraph (2) of the revised proposal provided that, for future investment treaties, a reference to the UNCITRAL Arbitration Rules in such treaties would be understood as including a reference to the rules on transparency.

After discussion, the Commission agreed that it would not be desirable to include specific provisions on treaty-based arbitration in the UNCITRAL Arbitration Rules themselves and that any work on investor-State disputes which the Working Group might have to undertake in the future should not delay the completion of the revision of the UNCITRAL Arbitration Rules in their generic form.

Article 1(1) and 1(2) reflect the compromise struck specifically with respect to references to the UNCITRAL Arbitration Rules in future and existing treaties.

In that respect, the Working Group recalled its recent works on transparency in treaty-based investor-State arbitration, including the revision to the UNCITRAL Arbitration Rules in 2013 in relation to the application of the UNCITRAL Rules on Transparency in Treaty-based Investor-State Arbitration (the " Rules on Transparency " ).

4. Mr. Sorieul (Secretary of the Commission) said that since the adoption of the decision reproduced in section C, paragraph 1 of the addendum to the draft report (A/CN.9/XLIII/CRP.1/Add.5), it had been pointed out that it would be worth drawing attention to the value of the UNCITRAL Arbitration Rules in the context of activities for the promotion of the rule of law.
