3- وتتضمَّن هذه المذكرة في بابها الثاني نص مشروع التوصيات لمساعدة مؤسسات التحكيم وغيرها من الهيئات المهتمة فيما يخص التحكيم بمقتضى قواعد الأونسيترال للتحكيم بصيغتها المنقَّحة في عام 2010.

ثانياً- مؤسسات التحكيم والهيئات المهتمة الأخرى التي تدير التحكيم بمقتضى قواعد الأونسيترال للتحكيم أو تقدم بعض الخدمات الإدارية

It was underlined that if the rules on transparency were to be applied only to arbitration under the UNCITRAL Arbitration Rules, that would permit an investor to choose to arbitrate under a different set of arbitration rules that did not include any transparency provisions.
وشُدِّد على أنه إذا طُبقت قواعد الشفافية على عمليات التحكيم بمقتضى قواعد الأونسيترال للتحكيم فقط، فمن شأن ذلك أن يتيح للمستثمر أن يختار إجراء التحكيم بمقتضى مجموعة قواعد تحكيم مغايرة لا تتضمن أيَّ أحكام بشأن الشفافية.

Two variants were proposed for consideration by the Working Group: variant 1 provided that the rules on transparency should apply in respect of arbitration initiated under any set of arbitration rules, and variant 2 limited the application of the rules to arbitration under the UNCITRAL Arbitration Rules.

جيم- مؤسسات التحكيم وغيرها من الهيئات المهتمة التي تدير التحكيم بمقتضى قواعد الأونسيترال للتحكيم أو تقدم بعض الخدمات الإدارية

This would expressly include the UNCITRAL rules on transparency as one of the standards of transparency which disputing parties may choose to apply in their arbitration, even if the treaty pursuant to which the arbitration is initiated provides for its own rules on transparency or does not provide for arbitration under the UNCITRAL Arbitration Rules.
ومن شأن ذلك أن يشمل صراحةً قواعد الأونسيترال للشفافية باعتبارها معياراً من معايير الشفافية التي يمكن للأطراف المتنازعة أن تختار تطبيقها على دعوى التحكيم الخاصة بها، حتى وإن كانت المعاهدة التي استهل التحكيم عملا بها تنص على قواعد خاصة بها للشفافية أو لا تنص على التحكيم بمقتضى قواعد الأونسيترال للتحكيم.
