Where a partial archipelagic sea lanes proposal has come into effect, the right of archipelagic sea lanes passage may continue to be exercised through all normal passage routes used as routes for international navigation or overflight in other parts of archipelagic waters in accordance with UNCLOS.

Likewise, in line with the provisions of article 53 of the Convention, on archipelagic waters, Indonesia has proposed that the Maritime Safety Committee consider the adoption of archipelagic sea lanes as well as the corresponding air routes, based on the need for safety in navigating the waters in and around the Indonesian archipelago.

131. The proposal notes that, pending the designation of other sea lanes through other parts of the archipelagic waters, the right of sea lanes passage may be exercised in the relevant archipelagic waters in accordance with the Convention.

Indonesia also recognizes that in the Convention the rights of States go hand-in-hand with their responsibilities, especially with respect to the protection of the marine environment, the proper management of ocean resources, and the necessary protection of the rights of other countries in the archipelagic waters.

1. Routes used for navigation 109. UNCLOS gives the coastal State the right to designate sea lanes and prescribe traffic separation schemes in its territorial sea (article 22), in straits used for international navigation (article 41) and in archipelagic waters (article 53).

197. The delegation of Indonesia then informed MSC that associated rules and regulations applicable to archipelagic sea lanes passage in Indonesian archipelagic waters had been developed on the basis of the pertinent articles of the Convention.

(a) Bahamas. The 1993 archipelagic waters and Maritime Jurisdiction Act of the Bahamas, which entered into force on 4 January 1996, covers archipelagic waters, internal waters, the territorial sea, innocent passage and the exclusive economic zone.

The Maritime Areas Act provides for the right of archipelagic sea lanes passage and defines the right of innocent passage in archipelagic waters and the territorial sea along with the empowerment of law-enforcement officers to stop, board, search and seize foreign ships when so warranted (see Law of the Sea Bulletin No. 34).

Since this will be the first time that IMO is asked to consider a proposal for the designation of archipelagic sea lanes, it has been proposed that IMO should first agree on and establish appropriate procedures for adopting such sea lanes, which, it is suggested, must take into account the legitimate rights and concerns of the archipelagic State and those of the States whose ships and aircraft transit archipelagic waters.125

The Convention contains very innovative provisions on such matters as exclusive economic zones, transit passage, archipelagic waters, marine scientific research and protection of the environment.

فكل طرف يبقى حرا في اتخاذ قرار بشأن السماح للسفن والطائرات اﻷجنبية الزائرة باستعمال موانئه ومطاراته، أو بعبور الطائرات اﻷجنبية لمجاله الجوي، أو للسفن اﻷجنبية بالملاحة في بحره الاقليمي أو مياهه اﻷرخبيلية بشكل لا تشمله حقوق المرور البريء أو عبور البحار اﻷرخبيلية أو المرور العابر بالمضائق.
