With reference to paragraph 37 of the State party's report, please provide information on the enjoyment of constitutional rights by migrant workers and members of their family who are undocumented.
وبالإشارة إلى الفقرة 37 من تقرير الدولة الطرف، يرجى تقديم معلومات عن التمتع بالحقوق الدستورية بالنسبة للعمال المهاجرين وأفراد أسرهم الذين ليست لديهم الوثائق اللازمة.

26. As regards migrant workers " who are undocumented " , in the words of the question, a distinction is drawn between the following two cases:

وإذ تضع في اعتبارها حالة الضعف التي كثيراً ما يجد المهاجرون أنفسهم فيها لأسباب عديدة من بينها غيابهم عن دولهم الأصلية، والصعوبات التي يواجهونها بسبب الاختلافات في اللغة والعادات والثقافة، وكذلك الصعوبات الاقتصادية والاجتماعية والعراقيل التي تعترض عودة المهاجرين إلى دولهم الأصلية، خاصة الذين ليست لديهم الوثائق اللازمة أو الذين هم في وضع غير قانوني،

وإذ تضع في اعتبارها حالة الضعف التي كثيراً ما يجد المهاجرون أنفسهم فيها لأسباب عديدة من بينها غيابهم عن دولهم الأصلية، والصعوبات التي يواجهونها بسبب اختلاف اللغة والعادات والثقافة، وكذلك الصعوبات الاقتصادية والاجتماعية والعراقيل التي تعترض عودة المهاجرين إلى دولهم الأصلية، خاصة الذين ليست لديهم الوثائق اللازمة أو الذين هم في وضع غير قانوني،

Encourages the Special Rapporteur to continue to examine ways and means of overcoming existing obstacles to the full and effective protection of the human rights of persons belonging to this large vulnerable group, including obstacles and difficulties for the return of migrants who are undocumented or in an irregular situation, in conformity with her mandate as contained in Commission on Human Rights resolution 1999/44;
5- تشجع المقررة الخاصة على مواصلة استكشاف سبل ووسائل تخطي العقبات القائمة أمام الحماية الكاملة والفعالة لحقوق الإنسان للأشخاص الذين ينتمون لهذه المجموعة الضعيفة الكبيرة العدد، بما فيها العقبات والصعوبات التي تعترض عودة المهاجرين الذين ليست لديهم الوثائق اللازمة أو الذين هم في وضع غير قانوني، طبقاً لولايتها الواردة في قرار لجنة حقوق الإنسان 1999/44؛
