5.1 On 23 March 2009, the author refuted the arguments of the State party.

6.4 Concerning the alleged violation of article 14 of the Covenant, the Committee has taken note of the arguments of the State party asserting that the elements of the complaint are incompatible ratione materiae with the provisions of the Covenant.

8-3 وتحيط اللجنة علماً بحجج الدولة الطرف التي تشير فيها إلى أن صاحب البلاغ لم يستنفد سبل الانتصاف المحلية لأنه لم يلجأ إلى مجلس الدولة بعد أن رفضت محكمة الاستئناف الإدارية في فرساي طلبه.

5.3 The author reiterates that he does not agree with the arguments of the State party that his trial was fair.
5-3 ويكرر صاحب البلاغ تأكيد اعتراضه على حجج الدولة الطرف التي تفيد بأن محاكمته كانت عادلة.

4. The Committee also responded to one of the arguments of the State party by stating:

5.1 In comments dated 15 March 2002, the authors supplied comments, restricted to the admissibility arguments of the State party.
5-1 قدم أصحاب البلاغ في 15 آذار/مارس 2002 تعليقات تقتصر على حجج الدولة الطرف بشأن مقبولية البلاغ.

The Committee, after examining the claims and evidence submitted by the complainant as well as the arguments of the State party, concluded that she had not advanced satisfactory evidence or details relating to her custody in the basement of a detention facility in Iran or escape from detention.
وبعد النظر في الادعاءات والأدلة التي قدمتها صاحبة الشكوى وفي حجج الدولة الطرف، انتهت اللجنة إلى أن صاحبة الشكوى لم تقدم ما يكفي من الأدلة أو التفاصيل المتعلقة بحجزها في قبو لمرفق احتجاز بإيران أو هربها من الاحتجاز.

The Committee, after examining all claims and evidence submitted by the complainant and the arguments of the State party, concluded that the complainant had failed to rebut in a sufficiently convincing manner the State party's objections on his credibility, and that he had been unable to validate the authenticity of a number of documents submitted.
وبعدما نظرت اللجنة في جميع الادعاءات والأدلة التي قدمها صاحب الشكوى وفي حجج الدولة الطرف، انتهت اللجنة إلى أن صاحب الشكوى لم يستطع بشكل مقنع تفنيد اعتراضات الدولة الطرف على مصداقيته وأنه لم يستطع إثبات صحة عدد من الوثائق المقدمة.

The Committee, after examining the claims and evidence submitted by the complainant as well as the arguments of the State party, concluded that the claimant had been unable to counter-argue the inconsistencies pointed out by the State party with regard to the documents provided and the testimony given.
وبعد دراسة الادعاءات والأدلة التي قدمها صاحب الشكوى وكذا حجج الدولة الطرف، انتهت اللجنة إلى أن صاحب الشكوى لم يستطع ضحد مواطن التضارب التي أشارت إليها الدولة الطرف فيما يتعلق بالوثائق المقدمة والشهادة المدلى بها.

7.6 In light of the conclusion reached by the Committee, it does not find it necessary to refer to the arguments of the State party related to the authors' abuse of the right of submission and the inadmissibility of the communication ratione temporis.
7-6 ولا ترى اللجنة، في ضوء الاستنتاج الذي توصلت إليه، ضرورة الإشارة إلى حجج الدولة الطرف المتعلقة بانتهاك صاحبي البلاغ لحق تقديم البلاغات وعدم مقبولية البلاغ من حيث الاختصاص الزماني.

Taking into account the arguments of the State party to justify the degree of force used during the arrest operation and given the contradictory information contained in the file as to the existence of witness testimonies on the facts alleged under this claim, the Committee concludes that the author failed to substantiate this claim, for purposes of admissibility, and declares it inadmissible under article 2 of the Optional Protocol.
وتحيط اللجنة علماً أيضاً بحجج الدولة الطرف التي تبرر فيها درجة القوة المستخدمة أثناء عملية القبض على صاحب البلاغ، ونظراً إلى المعلومات المتناقضة الواردة في الملف فيما يتعلق بوجود إفادات الشهود بشأن الوقائع المزعومة في إطار هذه الدعوى، فإن اللجنة تخلص إلى أن صاحب البلاغ لم يدعم ادعاءه بأدلة كافية لأغراض المقبولية وترى أن البلاغ غير مقبول بموجب المادة 2 من البروتوكول الاختياري.

5.1 In her submissions dated 4 February and 6 March 2000, counsel disputes the arguments of the State party regarding the failure of the author to submit written evidence.
5-1 قدمت المحامية مذكرتين مؤرختين 4 شباط/فبراير و6 آذار/مارس 2000 تطعن فيهما في الحجج التي ساقتها الدولة الطرف بشأن عدم تقديم صاحبة البلاغ أدلة مكتوبة.

In this connection, the arguments of the State party were identical to those put forward in relation to communication No. 470/1991.
وفي هذا الصدد، كانت الحجج التي قدمتها الدولة الطرف مطابقة للحجج التي قدمت فيما يتعلق بالبلاغ رقم ٠٧٤/١٩٩١.
