article VI of the Convention states that " [t]he Commission may from time to time make recommendations to any or all Contracting Governments on any matters which relate to whales or whaling and to the objectives and purposes of this Convention " .

In particular, the United Nations military observers shall enjoy the status of experts on mission within the meaning of article VI of the Convention.

This issue had been the subject of an opinion given by the United Nations Legal Counsel, which stated that Commission members were considered as experts on mission, covered by article VI of the Convention on the Privileges and Immunities of the United Nations.

2. When exercising their functions, the mandate-holders are entitled to privileges and immunities as provided for under relevant international instruments, including section 22 of article VI of the Convention on the Privileges and Immunities of the United Nations.

The Convention offers little guidance as to how this provision is to be applied, and instead provides the courts with a wide discretion to determine when to require security and in what amount and form.
46- يجوز للمحكمة التي تؤجِّل إجراءات التنفيذ عملا بالمادة السادسة من الاتفاقية أن تأمر أيضا " الطرف الآخر بتقديم الضمان المناسب " ولا تتضمن الاتفاقية إرشادات تُذكر بشأن كيفية تطبيق هذا الحكم، وهي تمنح المحاكم بدلا من ذلك صلاحية تقديرية واسعة كي تقرر متى تشترط تقديم ضمان ومبلغ الضمان وشكله.

Any State Party may lodge a complaint with the Security Council according to article VI of the Convention.

5. The investigative mechanism established under article VI of the Convention provides the best way to deal with violations of the Convention.

In particular, Section 22 (b) of article VI of the Convention provides:

1. article VI of the Convention

The secretariat staff will have the status of officials of the United Nations within the meaning of articles V and VII of the Convention, and the members of the Board and technical experts will have the status of experts on mission within the meaning of article VI of the Convention.
ويحظى موظفو الأمانة بمركز موظفي الأمم المتحدة في إطار المعنى الوارد في المادتين الخامسة والسابعة من الاتفاقية، ويحظى أعضاء المجلس والخبراء التقنيون بمركز خبراء مكلفين بمهام في إطار المعنى الوارد في المادة السادسة من الاتفاقية.

30. Similarly, in recent years, French courts have repeatedly refused to adjourn enforcement proceedings under article VI of the Convention.

3. Experts, other than officials coming within the scope of article VI of the Convention, serving on organs and bodies of, or performing missions for, the Organization, shall be accorded such privileges and immunities as are necessary for the independent and effective exercise of their functions, including the time spent on journeys in connection with service on organs and bodies or missions.
3 - يمنح الخبراء غير الموظفين الذين تشملهم المادة السادسة من الاتفاقية العاملون في الهيئات والأجهزة التابعة للمنظمة أو القائمون بمهام من أجلها الامتيازات والحصانات اللازمة لممارسة مهامهم باستقلال وفعالية، بما في ذلك أثناء الفترة التي يقضونها في سفر يتعلق بعملهم بهذه الهيئات والأجهزة أو في مهام لها.

20. Based on the statement of the Legal Counsel, the Commission decided that article VI of the Convention on the Privileges and Immunities of the United Nations shall apply mutatis mutandis to the members of the Commission, as experts on mission for the United Nations.
٠٢ - واستنادا إلى بيان المستشار القانوني، قررت اللجنة أن المادة السادسة من اتفاقية امتيازات وحصانات اﻷمم المتحدة تنطبق، بعد إدخال ما يلزم من تعديل، على اﻷعضاء بصفتهم خبراء يقومون بمهمة لﻷمم المتحدة.

The members of the Commission would have the status of experts on mission in accordance with article VI of the Convention and any staff of the Secretariat attached to the Commission would have the status of officials in accordance with articles V and VII of the Convention.
وسوف يتمتع أعضاء اللجنة بمركز خبراء البعثات وفقا للمادة السادسة من الاتفاقية ويتمتع بالمركز ذاته أي موظفين تابعين لﻷمانة العامة يلحقون باللجنة وفقا للمادتين الخامسة والسابعة من الاتفاقية.
