V). It was important to understand the basis for the use of that term.

The work of the International Law Commission on the matter of the scope of the draft articles on international liability arising out of acts not prohibited by international law has culminated in some important conclusions on the activities to be covered, on the threshold of harm or damage required for triggering the obligation and on specifying or clarifying the concept of “transboundary damage”.
