These elements include a clear definition of intent, of aggravating circumstances, of attempted torture, of acts of torture committed to intimidate or coerce a person or a third person and of acts of torture committed by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.

It also recalls that the definition of torture makes it clear that suffering constituting torture must be inflicted by/at the instigation of or with the consent/acquiescence of a public official or a person acting in an official capacity.

Article 1 requires that the act of torture be “committed by, or at the instigation of, or with the consent or acquiescence of a public official or any other person acting in an official capacity”.

Under article 16 of the Convention, " [e]ach State Party shall undertake to prevent in any territory under its jurisdiction other acts of cruel, inhuman or degrading treatment or punishment which do not amount to torture as defined in article I, when such acts are committed by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity (emphasis added). "

3. Pursuant to article 1, the criterion, mentioned in article 3, paragraph 2, of " a consistent pattern or gross, flagrant or mass violations of human rights " refers only to violations by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.

The HKSAR should consider adopting a more inclusive definition of the term " public official " in the definition of torture as to clearly include all acts inflicted by or at the instigation of or with the consent or acquiescence of all public officials or other persons acting in an official capacity.

The Committee recommends that the State party should take the necessary measures to ensure that every public official, or any other person acting in an official capacity or at the instigation of or with the consent or acquiescence of a public official, who is guilty of acts of torture should be prosecuted and receive a penalty commensurate with the seriousness of the acts committed.

Regarding the status of the LTTE as a non-State actor, article 1 of the Convention against Torture also refers to acts committed at " the instigation of or with the consent or acquiescence of " public officials.
