Those other parties shall likewise have neither rights nor obligations under those provisions in their relations with the author of the reservation.

4.3.1 Effect of an objection on the entry into force of the treaty as between the author of the objection and the author of the reservation
4-3-1 أثر الاعتراض على دخول المعاهدة حيز النفاذ بين الجهة المعترضة والجهة المتحفظة

In such cases, it might be advisable to enter into a dialogue with the author of the reservation to clarify its compatibility.
وفي تلك الحالات، قد يكون من المستصوب الدخول في حوار مع الجهة المبدية للتحفظ للتأكد من توافقه.

This has the consequence that the author of the reservation is one of the contracting States or contracting organizations even if the treaty has not yet entered into force.
ويترتب على ذلك انضمام الجهة المتحفظة إلى الدول المتعاقدة والمنظمات المتعاقدة إن لم تكن المعاهدة قد دخلت حيز النفاذ بعد.

A communication relating to a reservation shall be considered as having been made by the author of the reservation only upon its receipt by the State or organization to which it was transmitted.
لا يعتبر البلاغ المتعلق بتحفظ بلاغا صادرا عن الجهة المتحفظة إلا عندما تتسلمه الدولة أو المنظمة التي وجه إليها.

Such pre-emptive objections seemed to fulfil one of the most important functions of objections, namely to give notice to the author of the reservation.
ويبدو أن تلك الاعتراضات الوقائية تؤدي غرضاً من أهم أغراض الاعتراضات، هو إنذار الجهة المتحفظة.

In the absence of such opposition, the treaty shall apply between the author of the reservation and the author of the objection to the extent provided by the reservation and the objection.
وفي حال عدم وجود تلك المعارضة، تنطبق المعاهدة بين صاحب التحفظ وصاحب الاعتراض بالقدر المنصوص عليه في التحفظ والاعتراض.

The second condition was that the objection did not defeat the object and purpose of the treaty in the relations between the author of the reservation and the author of the objection.
والشرط الثاني هو ألا يخل الاعتراض بموضوع المعاهدة والغرض منها في العلاقات بين صاحب التحفظ وصاحب الاعتراض.

In the absence of such opposition, the treaty would apply between the author of the reservation and the author of the objection, to the extent provided by the reservation and the objection.
وفي حال عدم وجود هذه المعارضة، تنطبق المعاهدة بين صاحب التحفظ وصاحب الاعتراض بالقدر المنصوص عليه في التحفظ والاعتراض.

Paragraph 2 then provided a non-exhaustive list of factors that had to be taken into consideration in order to identify the intention of the author of the reservation.

315. For the treaty effectively to enter into force as between the author of the objection and the author of the reservation, it is both necessary and sufficient for the treaty to enter into force and for both the author of the reservation and the author of the objection to be contracting parties thereto.
315 - لكي تدخل المعاهدة حيز النفاذ فعلا بين الجهة المعترضة والجهة المتحفظة يجب ويكفي أن تكون المعاهدة قد دخلت حيز النفاذ وأن تكون الجهة المتحفظة والجهة المعترضة طرفين متعاقدين فيها.

Those provisions or parts or provisions are, by virtue of an objection, not applicable in treaty relations between the author of the objection and the author of the reservation.
وهذه الأحكام أو أجزاء الأحكام هي، بسبب الاعتراض، غير قابلة للتطبيق في العلاقة التعاهدية بين الجهة المبدية للاعتراض والجهة المبدية للتحفظ.

Draft guideline 2.6.4 essentially reproduced the presumption in the Vienna Conventions that a treaty would enter into force between the author of the reservation and the objecting State or international organization unless a contrary intention was definitely expressed by the latter.

However, such reactions are not objections within the meaning of the Vienna Conventions, and their effects relate to the interpretation of the treaty or the unilateral acts constituted by the reservations, or else they form part of the " reservations dialogue " that the treaty's other contracting States or organizations try to initiate with the author of the reservation.

They warrant no special comment, except for the observation that, even in cases where there is a depositary, the State that is the author of the reservation may directly inform the other States or international organizations concerned of the text of the reservation.
