2.3 Milhoud Ahmed Hussein Bashasha's arrest coincided with the mass arrests carried out by the Libyan authorities in 1989, when the regime was cracking down on perceived dissidents.

2.4 Milhoud Ahmed Hussein Bashasha's family and the author made numerous attempts to locate him.
2-4 وقد حاول كلٌ من أسرة ميلود أحمد حسين بشاشة وصاحب البلاغ مرات عديدة معرفة مكانه.

Given that the Milhoud Ahmed Hussein Bashasha had been arrested by persons in civilian clothing, his family strongly suspected that he was arrested on political, rather than criminal grounds, as none of the minimal procedural formalities were maintained.
وبما أن ميلود أحمد حسين بشاشة قد ألقي عليه القبض من قبل أشخاص بزي مدني فإن أسرته مالت بشدة إلى الاعتقاد بأنه اعتقل لأسباب سياسية لا جنائية نظراً لعدم التقيد بأدنى الشكليات الإجرائية.

2.2 In October 1989, Milhoud Ahmed Hussein Bashasha was arrested for unknown reasons by plain-clothes agents of the Libyan Internal Security Agency.
2-2 وفي تشرين الأول/أكتوبر 1989 ألقي القبض على ميلود أحمد حسين بشاشة لأسباب مجهولة من قبل ضباط من جهاز الأمن الداخلي الليبي بزي مدني.

The Committee observes that on 20 June 2009, the family was provided with Milhoud Ahmed Hussein Bashasha's death certificate, without any explanation as to the cause or the exact place of his death or any information on any investigations undertaken by the State party.
وتلاحظ اللجنة أن الأسرة حصلت، في 20 حزيران/يونيه 2009، على شهادة وفاة ميلود أحمد حسين بشاشة دون أن تقدم إليها أي إيضاحات بشأن سبب الوفاة أو المكان المحدد الذي حدثت فيه الوفاة أو معلومات عن أي تحقيقات أجرتها الدولة الطرف.

138. Other communications in which the Committee found violations of article 2, paragraph 3, read together with other provisions of the Covenant, include cases No. 1610/2007 (L.N.P. v. Argentina), No. 1761/2008 (Giri et al. v. Nepal) and 1776/2008 (Ali Bashasha and Hussein Bashasha v. Libyan Arab Jamahiriya).

In the absence of any satisfactory explanation by the State party concerning the disappearance of the author's cousin, his detention since 1989, having been prevented from communicating with his family and the outside world and his unexplained death in 1996, the Committee considers that Milhoud Ahmed Hussein Bashasha's enforced disappearance constitutes a violation of article 7 of the Covenant.
ونظراً لعدم تقديم الدولة الطرف تفسير مقنعاً لاختفاء ابن عم صاحب البلاغ واحتجازه منذ عام 1989، ومنعه من التواصل مع أسرته والعالم الخارجي ووفاته المجهولة الأسباب في عام 1996، فإن اللجنة ترى أن الاختفاء القسري لميلود أحمد حسين بشاشة يشكل انتهاكاً لأحكام المادة 7 من العهد().

165. Violations of article 10 were also found in cases No. 1412/2005 (Butovenko v. Ukraine), No. 1530/2006 (Bozbey v. Turkmenistan), No. 1751/2008 (Aboussedra et al. v. Libyan Arab Jamahiriya), No. 1776/2008 (Ali Bashasha and Hussein Bashasha v. Libyan Arab Jamahiriya), No. 1780/2008 (Aouabdia et al. v. Algeria), No. 1813/2008 (Akwanga v. Cameroon) and No. 1818/2008 (McCallum v. South Africa).

A similar remedy was recommended in cases No. 1776/2008 (Ali Bashasha and Hussein Bashasha v. Libyan Arab Jamahiriya), where the Committee added a request for the State party to return to the family the victim's remains, and No. 1780/2008 (Aouabdia et al. v. Algeria), where the State was requested to free the victim immediately if he was still in incommunicado detention or, if the victim were dead, to hand over his remains to his family.
وقدمت توصية بتقديم سبيل انتصاف مماثل في القضية رقم 1776/2008 (علي بشاشة وحسين بشاشة ضد الجماهيرية العربية الليبية)، حيث أضافت اللجنة على ذلك طلبات بأن تعيد الدولة الطرف رفاة الضحية إلى أسرته، وفي القضية رقم 1780/2008 (عوابدية وآخرون ضد الجزائر)، حيث طُلب من الدولة الإفراج عن الضحية فوراً إن كان لا يزال في الاعتقال السري، أو تسليم رفاته إلى أسرته إن كان متوفياً.
