According to one point of view, the final version of this guideline deserved support in that it had moved away from a stricter presumption of severability, that is, that the author of an invalid reservation continued to be bound by the treaty without the benefit of the reservation, by recognizing the decisive role of the intention expressed by the reserving State.

The provision according to which the author of an invalid reservation could express at any time its intention not to be bound by the treaty without the benefit of the reservation was criticized by some delegations.
وانتقدت بعض الوفود الحكم الذي يجيز لصاحب التحفظ غير الصحيح أن يبدي في أي وقت نيته عدم الالتزام بالمعاهدة بدون الاستفادة من التحفظ.

First, the fact that it was rebuttable could lead to uncertainty as to whether or not a reserving State had become a party to a treaty. That was the case when doubt had been cast on the permissibility of the State's reservation and the State did not intend to be bound by the treaty without the reservation.

Thus, a preference was expressed by some delegations for the opposite presumption, according to which a State or an international organization having formulated an invalid reservation should be regarded as not being bound by the treaty at all, unless that State or organization had manifested its intention to be bound by the treaty without the benefit of the reservation.

There are many possible formulations of the " contrary intention " of the author of the reservation not to be bound by the treaty without the benefit of the reservation, the intention referred to in paragraph 2 of guideline 4.5.3.

41. One of the main problems addressed by the Commission had been whether the invalidity of a reservation would mean that the author of the reservation would be bound by the treaty without the benefit of the reservation, or would not be bound by the treaty at all.
