1. The conduct of a person or a group of persons not acting on behalf of the State shall not be considered as an act of the State under international law.
١ - لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف شخص أو مجموعة من اﻷشخاص لا يعمل لحساب هذه الدولة.

The conduct of an organ of an international organization acting in that capacity shall not be considered as an act of a State under international law by reason only of the fact that such conduct has taken place in the territory of that State or in any other territory under its jurisdiction.
لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف جهاز من أجهزة منظمة دولية، يعمل بهذه الصفة، لمجرد القيام بهذا التصرف في إقليم تلك الدولة أو في أي إقليم آخر خاضع لولايتها.

But it recognizes `nevertheless' that conduct is to be considered as an act of State `if and to the extent that the State acknowledges and adopts the conduct in question as its own'.

We would note, however, that draft article 11 applies the converse rule to article 8: “The conduct of a person or a group of persons not acting on behalf of the State shall not be considered as an act of the State under international law.” This provision adds nothing to the draft.
غير أننا نلاحظ أن مشروع المادة ١١ يطبق القاعدة المعاكسة للمادة ٨، إذ تنص على ما يلي: " لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف شخص أو فريق من اﻷشخاص لا يعمل لحساب هذه الدولة " . فهذا الحكم لا يضيف شيئا إلى المشروع.

١ - يعتبر فعلا صادرا عن الدولة أيضا بمقتضى القانون الدولي تصرف أي جهاز تابع لكيان حكومي إقليمي داخل الدولة، شريطة أن يكون ذلك الجهاز قد تصرف بهذه الصفة في الحالة المعنية؛

The conduct of an organ which has been placed at the disposal of a State by another State or by an international organization shall be considered as an act of the former State under international law, if that organ was acting in the exercise of elements of the governmental authority of the State at whose disposal it has been placed.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف أي جهاز تضعه دولة أخرى أو منظمة دولية تحت تصرفها، إذا كان تصرف هذا الجهاز ينطوي على ممارسة بعض اختصاصات السلطة الحكومية للدولة التي يكون الجهاز موضوعا تحت تصرفها.

1. The conduct of an organ of a State acting in that capacity which takes place in the territory of another State or in any other territory under its jurisdiction shall not be considered as an act of the latter State under international law.
١ - لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي ما يقع في إقليمها أو في أي إقليم آخر خاضع لولايتها من تصرف جهاز تابع لدولة أخرى ويعمل بهذه الصفة.

1. The conduct of an organ of an insurrectional movement which is established in the territory of a State or in any other territory under its administration shall not be considered as an act of that State under international law.
١ - لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف جهاز من أجهزة حركة تمردية قائمة في إقليم هذه الدولة أو في إقليم آخر خاضع لولايتها.

The conduct of an entity which is not part of the formal structure of the State but which is empowered by the law of that State to exercise elements of the governmental authority shall also be considered as an act of the State under international law, provided the entity was acting in that capacity in the case in question.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي أيضا تصرف أي كيان لا يشكل جزءا من البنية الرسمية للدولة ولكن يخوله قانون تلك الدولة صلاحية ممارسة بعض اختصاصات السلطة الحكومية شريطة أن يكون الكيان قد تصرف بهذه الصفة في الحالة المعنية.

٢ - يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي أيضا تصرف أي جهاز تابع لكيــان لا يشكل جزءا من البنية الرسمية للدولة أو لكيان حكومي إقليمي فيها ولكن يخوله القانون الداخلي لتلك الدولة صلاحية ممارسة بعض اختصاصات السلطة الحكومية، شريطة أن يكون ذلك الجهاز قد تصرف بهذه الصفة في الحالة المعنية.

36. Similarly, article 5 provides that the conduct of a person or entity which is not an organ of the State under article 4, but which is empowered by the law of the State to exercise elements of governmental authority shall be considered as an act of the State under international law, provided that the person or entity in question was acting in that capacity in the instance in question.
36 - كذلك، تنص المادة 5 على أنه " يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف شخص أو كيان لا يشكل جهازا من أجهزة الدولة بمقتضى المادة 4 ولكن يخوله قانون تلك الدولة صلاحية ممارسة بعض اختصاصات السلطة الحكومية، بشرط أن يكون الشخص أو الكيان قد تصرف بهذه الصفة في الحالة المعينة " .
