Article 12 of the Convention against Torture expressly obligates States parties to investigate all allegations of torture, asserting that each State party should ensure that its competent authorities proceed to a prompt and impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction.
49- وتلزم المادة 12 من اتفاقية مناهضة التعذيب صراحة الدول الأطراف بالتحقيق في جميع ادعاءات التعذيب، وتؤكد أن على كل دولة طرف أن تضمن قيام سلطاتها المختصة بتحقيق فوري ونزيه كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتكب في أي من الأقاليم الخاضعة لولايتها القضائية.

(b) Launch prompt and impartial investigations spontaneously whenever there are reasonable grounds to believe that an act of torture has been committed;

10.6 In the light of the above, the Committee considers that there was a failure on the part of the authorities to conduct an investigation and that this was incompatible with the State party's obligations under article 12 of the Convention to ensure that the authorities proceed to a prompt and impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed.

3.5 The complainant also maintains that, in the case of Mounir Hammouche, the State party has violated article 12 of the Convention, which requires States parties to proceed to a prompt and impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed.

According to article 12, States parties shall undertake prompt, effective and impartial investigations, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction as the result of its actions or omissions and, as set out in article 13 and affirmed by the Committee in its general comment No. 2, ensure that impartial and effective complaints mechanisms are established.

The complainant recalls that the Committee found the provisions not consistent with the obligation of every State party to conduct an impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed on territory under its jurisdiction, to prosecute the perpetrators of such acts and to compensate the victims.

These provisions are not consistent with the obligation of every State party to conduct an impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction, to prosecute the perpetrators of such acts and to compensate the victims (arts. 12, 13 and 14).
