3. According to the State party, in assessing whether there are substantial grounds for believing that they face a real risk of being subjected to treatment contrary to article 3 of the Convention, the credibility that can be attached to their statements is significant.

7.9 The State party concludes that the authors have not shown the existence of substantial grounds for believing that they would be in danger of being subjected to torture if the expulsion order were to be carried out.

249. The Namibian authorities should institute proper procedures in order to comply with article 3 of the Convention, i.e. to enable refugees to apply for residence in cases where substantial grounds exist for believing that they would be in danger of being subjected to torture if expelled, returned or extradited to another country.
٢٤٩ - وينبغي أن تتخذ السلطات الناميبية إجراءات مناسبة للامتثال للمادة ٣ من الاتفاقية، أي لتمكين اللاجئين من طلب الحصول على إذن باﻹقامة في الحالات التي تتوافر فيها أسباب حقيقية تدعو إلى الاعتقاد بأنهم سيواجهون خطر التعرض للتعذيب لو طردوا أو ردوا أو سلموا إلى بلد آخر.

170. The Committee is also concerned that there are allegations that individuals have been expelled from Jordan to countries where there are substantial grounds for believing that they would be in danger of being subjected to torture in contravention of article 3 of the Convention.
١٧٠ - ويساور اللجنة القلق أيضا لوجود ادعاءات بأن أفرادا قد طردوا من اﻷردن الى بلدان حيث تتوافر أسباب حقيقية تدعو الى الاعتقاد بأنهم سيكونون في خطر التعرض للتعذيب انتهاكا للمادة ٣ من الاتفاقية.

7.1 The Committee must decide whether the forced return of the complainants to Sri Lanka would violate the State party's obligation, under article 3, paragraph 1, of the Convention, not to expel or return (refouler) individuals to another State where there are substantial grounds for believing that they would be in danger of being subjected to torture.

10.6 As to the risk of torture at the time the complainant was removed, the Committee must determine whether, in sending the complainant back to India, the State party failed to meet its obligation under article 3 of the Convention not to expel or return anyone to another State where there are substantial reasons for believing that they would be in danger of being subjected to torture.
10-6 وفيما يتعلق بوجود خطر التعرض للتعذيب وقت إبعاد صاحب الشكوى، على اللجنة أن تبت في ما إذا كان ترحيل صاحب الشكوى إلى الهند يشكل خرقاً لالتزام الدولة الطرف بموجب المادة 3 من الاتفاقية بعدم طرد أي شخص أو إعادته إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيتعرض لخطر التعذيب.

Nor have they demonstrated any inaccuracy in the State party's conclusion that the situation in Sri Lanka is not such that for Tamils in general, even if they are from the north of the country, substantial grounds exist for believing that they risk torture if returned from abroad.
كما لم يثبت مقدما البلاغ أي وجه من أوجه عدم الدقة فيما خلصت إليه الدولة الطرف من أن الحالة في سري لانكا ليست على النحو الذي يوحي بوجود أسباب جوهرية للاعتقاد بأن التاميل بوجه عام، ولو كانوا من الوافدين من شمال البلد، معرضون لخطر التعذيب إذا ما عادوا من الخارج.

They claimed that there were substantial grounds for believing that they would be subjected to torture by the security forces as well as by families seeking revenge for their husband's/father's involvement with and support of rebel forces.
