Equally covered are conflicts between an assignee and a creditor of the assignor or the administrator in the insolvency of the assignor.
كذلك فإنه يغطي حالات التنازع بين محال اليه ودائن للمحيل أو مدير لاعسار المحيل.

Accordingly, a conflict between an assignee and such a person would be subject to article 1 and not to article 2 of the annex.

The European Council (EC) Regulation No. 1346/2000 of 29 May 2000 on insolvency proceedings would refer conflicts of priority between an assignee and an insolvency administrator to the law of the member State in which the insolvency proceeding is opened (see article 4).
60- ولائحة المجلس الأوروبي رقم 1346/2000، المؤرخة 29 أيار/مايو 2000 والمتعلقة باجراءات الاعسار، تحيل التنازع بشأن الأولوية بين المحال اليه ومدير الاعسار الى المكان الذي تُستهل فيه اجراءات الاعسار (انظر المادة 4).

Article 24 of the Convention refers conflicts between an assignee and an insolvency administrator to the law of the location of the assignor.
فالمادة 24 من الاتفاقية تحيل النـزاعات بين محال اليه ومدير اعسار الى قانون مقر المحيل.

Matters that are not addressed and are left to law outside the draft Convention include statutory limitations on assignment, other than those dealt with in articles 9, 11 and 12, and issues relating to priority between an assignee and a competing claimant, as well as to capacity and authority.
ومن المسائل التي لا يتناولها ويتركها للقانون المنطبق خارج نطاق مشروع الاتفاقية التقييدات القانونية على الاحالة، غير التي تتناولها المواد 9 و11 و12، والمسائل المتعلقة بالأولوية بين محال اليه ومُطالِب منازع، وكذلك المسائل المتعلقة بالأهلية والصلاحية.

The definition is intended to ensure that all potential priority conflicts are covered, including conflicts between a domestic and a foreign assignee of domestic receivables, between an assignee and a creditor with an interest in other property extended to the receivables flowing from that property and between an assignee in an assignment made before and an assignee in an assignment made after the draft Convention enters into force.
ويقصد من التعريف ضمان أن يغطي جميع منازعات الأولوية المحتملة، بما فيها المنازعات بين محال اليه محلي ومحال اليه أجنبي لمستحق محلي، والمنازعات بين محال اليه ودائن ذي حق في ممتلكات أخرى يمدد إلى المستحقات الناشئة عن تلك الممتلكات، والمنازعات بين محال اليه في احالة تجري قبل بدء سريان مشروع الاتفاقية ومحال اليه في احالة تجري بعد بدء ذلك السريان.

The view was expressed that conflicts of priority between an assignee and an administrator in the insolvency of the assignor should be subjected to the law governing the insolvency proceeding (lex fori concursus).
٤٣ - وأعرب عن رأي مفاده أن تنازع اﻷولوية بين محال اليه ومدير لاعسار المحيل ينبغي أن يخضع للقانون الذي يخضع له اجراء الاعسار )قانون البلد الذي تقام فيه الدعوى( .

However, a conflict between an assignee in a Contracting State and an assignee in a non-Contracting State is not covered (as to conflicts arising between parties to assignments made before and after a declaration takes effect, or the draft Convention enters into force or is denounced, see articles 43, paragraph 7, 45, paragraph 4, and 46, paragraph 4 respectively).
بيد أن المادة لا تغطي تنازعا بين محال اليه في دولة متعاقدة ومحال اليه آخر في دولة غير متعاقدة (فيما يتعلق بالنـزاعات التي تنشأ بين أطراف في احالات قبل وبعد أن يصبح اعلان ما نافذ المفعول أو يبدأ نفاذ مشروع الاتفاقية أو الانسحاب منها، انظر المواد 43، الفقرة 7، و45، الفقرة 4، و46، الفقرة 4، على التوالي).
