Article 9 of Annex II to the Convention unequivocally states that " the actions of the Commission shall not prejudice matters relating to delimitation of boundaries between States with opposite or adjacent coasts " .

Before addressing them specifically, he observed that in general these communications concerned the issue of overlapping continental shelf entitlements and the determination of continental shelf boundaries between States with opposite or adjacent coasts and that Nicaragua had communicated its views through five notes verbales, all dated 20 December 2013, addressed to the Secretary-General.

77. The purpose of the Commission is to facilitate the implementation of the Convention in respect of the establishment of the outer limits of the continental shelf beyond 200 miles from the baselines from which the breadth of the territorial sea is measured; its recommendations and actions shall not prejudice matters relating to the delimitation of boundaries between States with opposite or adjacent coasts.

1. The delimitation of the continental shelf between States with opposite or adjacent coasts shall be effected by agreement on the basis of international law, as referred to in Article 38 of the Statute of the International Court of Justice, in order to achieve an equitable solution.
١ - يتم تعيين حدود الجرف القاري بين الدول ذات السواحل المتقابلة أو المتلاصقة عن طريق الاتفاق على أساس القانون الدولي، كما أشير إليه في المادة ٣٨ من النظام اﻷساسي لمحكمة العدل الدولية، من أجل التوصل إلى حل منصف.

8. On the question of delimitation of boundaries between States with opposite or adjacent coasts (rule 44), it was decided that the Chairman would undertake consultations among members and submit a draft rule to the Commission for its consideration.
٨ - وفيما يتصل بمسألة تعيين الحدود بين الدول ذات السواحل المتقابلة أو المتلاصقة )المادة ٤٤(، تقرر أن يُجري الرئيس مشاورات بين اﻷعضاء وأن يقدم إلى اللجنة مشروع مادة بهذا الصدد لتنظر فيها.

Consequently, Costa Rica rejects the claims advanced by Nicaragua in its submission, considers them to be without legal effect, reserves its rights in this regard and refers the Commission to its Rules of Procedure, specifically rule 46 and annex I, governing submissions in case of a dispute between States with opposite or adjacent coasts or in other cases of unresolved land or maritime disputes.

43. Regarding the first category of issues, the Chairman of the Commission brought to the attention of the Meeting annex I of the Rules of Procedure entitled " Submissions in case of a dispute between States with opposite or adjacent coasts or in other cases of unresolved land or maritime disputes " .
٤٣ - وبالنسبة للطائفة اﻷولى من المسائل، لفت رئيس لجنة حدود الجرف القاري انتباه الاجتماع إلى المرفق اﻷول في النظام الداخلي المعنون " الطلبات المقدمة في حالة وجود نزاع بين الدول ذات السواحل المتقابلة أو المتلاصقة أو في حالات النزاع البري أو البحري اﻷخرى التي لم تحل " .

90. In reference to paragraph 2 (a) of annex I to the rules of procedure, she informed the Commission that there are unresolved disputes in the area covered by the submission, and stated that the submission does not prejudice matters relating to the delimitation of boundaries between States with opposite or adjacent coasts.
