20. At first sight, the second view may find support in a statement by the International Court of Justice in its opinion on the Interpretation of the Agreement of 25 March 1951 between the WHO and Egypt, in which the Court said:
20 - وللوهلة الأولى، لعل الرأي الثاني يحظى بتأييد في بيان لمحكمة العدل الدولية في فتواها بشأن تفسير اتفاق 25 آذار/مارس 1951 بين منظمة الصحة العالمية ومصر، عندما قالت المحكمة:

(b) Closer cooperation and coordination between the WHO and BWC in order to build an integrated approach on biosecurity and biosafety;

33. The Court has in the past extended the question posed in order to reply to it as fully as possible (Interpretation of the Agreement of 25 March 1951 between the WHO and Egypt, Advisory Opinion, I.C.J. Reports 1980, pp. 8889, para. 35).

As the Court stated in 1980, " in situations in which political considerations are prominent it may be particularly necessary for an international organization to obtain an advisory opinion from the Court as to the legal principles applicable with respect to the matter under debate " (Interpretation of the Agreement of 25 March 1951 between the WHO and Egypt, Advisory Opinion, I.C.J. Reports 1980, p. 87, para. 33).

3. Even if draft articles are only to be endorsed by the United Nations General Assembly, it is important that they are developed " under general rules of international law, under [the organizations' ] constitutions or under international agreements to which [the organizations] are parties " , as the International Court of Justice put it in the advisory opinion on the Interpretation of the Agreement of 25 March 1951 between the WHO and Egypt.
