(a) A mechanism for the consideration of claims by another State Party against illicitly acquired assets involved in a confiscation proceeding; and
(أ) انشاء آلية للنظر في المطالبات المقدمة من دولة طرف أخرى بشأن الموجودات المكتسبة بصورة غير مشروعة والمشمولة باجراء مصادرة؛ و

21. The Convention includes a mechanism to provide assistance where a State Party has been attacked with a biological weapon by another State Party.
21- تتنص الاتفاقية على آلية لتقديم المساعدة إلى الدولة الطرف التي تتعرض لهجوم بأسلحة بيولوجية من جانب دولة طرف أخرى.

4.3 To the extent that the author complains that the State party failed to meet its obligations under the Convention by denying her a residence permit, notwithstanding the treatment to which she was subjected in Mongolia, the State party submits that it cannot be held liable for a violation, real or alleged, of the Convention by another State Party.
4-3 وفيما يتعلق بشكوى صاحبة البلاغ من أن الدولة الطرف لم تف بالتزاماتها بموجب الاتفاقية برفض منحها تصريح إقامة، بالرغم من المعاملة التي تعرضت لها في منغوليا، تؤكد الدولة الطرف أنها لا يمكن أن تعتبر مسؤولة عن أي انتهاك، حقيقي أو مدَّعى، للاتفاقية من جانب دولة طرف أخرى().

3. When acting on the request made by another State Party in accordance with articles 11 and 12 of this Convention, a State Party may give special consideration to concluding agreements or arrangements on the return of funds derived from acts of corruption to their countries of origin in accordance with the provisions of article 19 of this Convention.
3- يجوز للدولة الطرف، عند اتخاذ إجراء بناء على طلب مقدم من دولة طرف أخرى وفقا للمادتين 11 و12 من هذه الاتفاقية، أن تنظر بعين الاعتبار الخاص في إبرام اتفاقات أو ترتيبات بشأن اعادة الأموال المتأتية من أفعال فساد إلى بلدانها الأصلية وفقا لأحكام المادة 19 من هذه الاتفاقية.

All parties except Romania and the Russian Federation (partial implementation) provided information on domestic measures enabling competent national authorities to give effect to a request for confiscation received by another State Party (art. 55, para. 1).

وأشارت تركيا الى التنفيذ الجزئي لتدابير تسمح للسلطات الوطنية المختصة بانفاذ أمر مصادرة ورد من دولة طرف أخرى (الفقرة 1 من المادة 55). .

The Conference recognizes that, in case a State Party is being fully committed to all provisions of the Convention is denied by another State Party for receiving equipment and materials for the peaceful application of biology and biotechnology, it should have the right to seek to redress the situation and to settlement of disputes through institutionalized measures.
11- ويقر المؤتمر بأنه، في الحالة التي تواجه فيها دولة طرف ملتزمة التزاماً تاماً بجميع أحكام الاتفاقية رفضاً من دولة طرف أخرى لحصولها على معدات ومواد متصلة بالاستخدام السلمي للبيولوجيا والتكنولوجيا الأحيائية، يحق لهذه الدولة طلب معالجة الوضع وتسوية المنازعات عن طريق تدبير مؤسسي.

3. When acting on the request made by another State Party in accordance with article [...] [Confiscation and seizure] or article [...] [International cooperation for purposes of confiscation] of this Convention, a State Party may give special consideration to concluding agreements or arrangements on:
3- يجوز للدولة الطرف، عند اتخاذ إجراء ما بناء على طلب مقدم من دولة طرف أخرى وفقا للمادة [...] [المصادرة والحجز] أو للمادة [...] [التعاون الدولي لأغراض المصادرة] من هذه الاتفاقية، أن تنظر بعين الاعتبار الخاص في إبرام اتفاقات أو ترتيبات بشأن:

4. (a) Following a request made pursuant to this article by another State Party having jurisdiction over an offence established in accordance with article(s) ____, the State Party in whose territory proceeds, property, instrumentalities or any other things referred to in paragraph 1 of this article are situated shall:
٤)أ( إذا قدم طلب عملا بهذه المادة من دولة طرف أخرى لها ولاية قضائية في جريمة منصوص عليها في المادة )المواد( ـــــ قامت الدولة الطرف التي تقع في إقليمها المتحصلات أو اﻷموال أو الوسائط أو أي أشياء أخرى من المشار إليها في هذه المادة بما يلي:

Reporting on measures enabling competent national authorities to give effect to a request for confiscation received by another State Party (art. 55, para. 1) and fulfilling an optional reporting requirement, Colombia quoted relevant legislation and added that requests for confiscation received from such neighbouring countries as Panama and Ecuador were frequently executed by its competent authorities.
وفي معرض التبليغ عن التدابير التي تسمح للسلطات الوطنية المختصة بانفاذ أمر مصادرة ورد من دولة طرف أخرى (الفقرة 1 من المادة 55) واستيفاءً لمطلب تبليغ اختياري، اقتبست كولومبيا من التشريعات ذات الصلة وأضافت أن سلطاتها المختصة كثيرا ما تنفذ طلبات مصادرة ترد من بلدان مجاورة مثل بنما واكوادور.

Thus, it imposes the obligation for the States parties to adopt such legislative and other measures that would enable their competent authorities, when acting on a request made by another State Party, to return confiscated property, taking into account the rights of bona fide third parties (art. 57, para. 2).
وهي بذلك تُلزم الدول الأطراف بأن تعتمد من التدابير التشريعية وغيرها من التدابير ما يُمكِّن سلطاتها المختصة من أن تعيد المملكات المصادرة بناء على طلب من دولة طرف أخرى وبمراعاة حقوق الأطراف الثالثة حسنة النية (الفقرة 2 من المادة 57).

The State party considers that certain passages in that statement rightly reflect the position under international law, and in particular articles 19-23 of the Vienna Convention on the Law of Treaties, that it is for the States parties rather than the Committee to make binding determinations of whether a reservation entered by another State Party is impermissible as being incompatible with the object and purpose of the Convention.
وتعتبر الدولة الطرف أن مقاطع معينة في ذلك البيــان تعكس عن حق الموقف بموجب القانون الدولي، ولا سيما المواد 19-23 من اتفاقية فيينا لقانون المعاهدات، وهو أنه يتعين على الدول الأطراف وليس اللجنة اتخاذ قرارات ملزمة بشأن ما إذا كان التحفظ المقدم من دولة طرف أخرى غير مسموح به نظرا لتنافيه مع مقصد الاتفاقية والغرض منها.
