وذهب أحد الآراء إلى أن مشروع المبدإ التوجيهي هذا يناقض مشروع المبدإ التوجيهي 2-3-4 ( " الاستبعاد أو التعديل اللاحق للأثر القانوني المترتب على معاهدة بوسائل غير التحفظات " ) لأنه لم يكن من الممكن أبداً التوسع في تفسير أي تحفظ سابق ولو وافقت الأطراف في المعاهدة عليه.
