فالقانون رقم 25/82 المؤرخ 7 تموز/يوليه 1982 والمتعلق بتسليم الأجانب، ينص في مادته الأولى على أنه " في حال عدم وجود معاهدة أو اتفاقية، تحدد شروط التسليم وإجراءاته وآثاره بموجب أحكام هذا القانون.

Article 696 of the Code of Criminal Procedure clearly underscores the subsidiary character of legislative provisions on extradition, as follows: " In the absence of an international treaty providing otherwise, the conditions, procedure and effects of extradition shall be determined by the provisions of this chapter.
وتؤكد المادة 696 من قانون الإجراءات الجنائية صراحة الطابع الفرعي للأحكام التشريعية المتعلقة بالتسليم، حيث تنص على ما يلي: " تحدد ظروف وإجراءات وآثار التسليم بموجب أحكام هذا الفصل، ما لم توجد اتفاقية دولية تنص على خلاف ذلك.
