We believe that, as it now stands, the language of that paragraph permits attribution by the successor State of its nationality to persons who have their permanent residence in the territory of the successor State and who have the nationality of another State.

In fact, the latter type of reservation could hardly be considered to have been maintained by the successor State, since on the date of succession they produced no legal effect, not having been formally confirmed by the State in question at the time of expression of consent to be bound by the treaty, as required under article 23, paragraph 2, of the 1969 and 1986 Vienna Conventions.
ذلك أنه لا وجه للإبقاء على هذه التحفظات إزاء دولة خَلَف لأنها، في تاريخ خلافة الدول، لم تكن تُحدِث أي أثر قانوني لعدم تأكيدها رسمياً من الدولة المعنية لدى إعرابها عن رضاها بالارتباط بالمعاهدة، على نحو ما تقتضيه الفقرة 2 من المادة 23 من اتفاقيتي فيينا لعامي 1969 و 1986.
