44. The rights and obligations of the parties under this Agreement do not merge on completion of any transaction contemplated by this Agreement.
44 - لا تُدمج حقوق الأطراف والتزاماتها بموجب هذا الاتفاق عند إتمام أي معاملة متوخاة في هذا الاتفاق.

If the carrier agrees to assume obligations other than those imposed on the carrier under this Convention, or agrees that the limits of its liability are higher than the limits specified under this Convention, a maritime performing party is not bound by this Agreement unless it expressly agrees to accept such obligations or such higher limits.
2- إذا وافق الناقل على تحمل واجبات غير تلك المفروضة عليه بمقتضى هذه الاتفاقية، أو وافق على أن تتجاوز حدود مسؤوليته الحــدود المنصوص عليها في هذه الاتفاقية، لا يكون الطرف المنفّذ البحري ملزما بهذه الموافقة ما لم يوافق صراحة على قبول تلك الواجبات أو تلك الحدود الأعلى.

We declare, therefore, that we are not bound by this Agreement and will not apply it provisionally.
ولهذا نعلن أننا لسنا ملتزمين بهذا الاتفاق ولن نطبقه مؤقتا.

CONSENT TO BE BOUND No State or regional economic integration organization may establish its consent to be bound by this Agreement, unless it has previously established or establishes at the same time its consent to be bound by the Protocol.
1- لا يجوز لأية دولة أو منظمة تكامل اقتصادي إقليمية أن تعلن قبولها الالتزام بهذا الاتفاق ما لم تكن قد أعلنت سابقاً، أو ما لم تعلن في نفس الوقت، قبولها الالتزام بالبروتوكول.

In the event of the notification referred to in paragraph 4 above, consent to be bound by this Agreement shall be established in accordance with paragraph 2 (c) above.
5- في حال تقديم الإخطار المشار إليه في الفقرة 4 أعلاه، يتم إثبات قبول الالتزام بهذا الاتفاق وفقاً للفقرة 2(ج) أعلاه.

Contracting party means a Government, or an intergovernmental organization as provided for in article 4, which has consented to be bound by this Agreement provisionally or definitively;
4- الطرف المتعاقد يعني أي حكومة أو أي منظمة حكومية دولية، على النحو المنصوص عليه في المادة 4، ارتضت أن تلتزم بهذا الاتفاق التزاما مؤقتا أو نهائيا؛

2. " Contracting party " means a Government, or an intergovernmental organization referred to in article 5, which has consented to be bound by this Agreement provisionally or definitively;
٢- يعني " الطرف المتعاقد " أي حكومة أو أي منظمة حكومية دولية مشار اليها في المادة ٥، وافقت على أن تلتزم بهذا الاتفاق التزاما مؤقتا أو نهائيا؛

1. After the adoption of this Agreement, any instrument of ratification or formal confirmation of or accession to the Convention shall also represent consent to be bound by this Agreement.
قبول اﻹلتزام ١ - بعد اعتمــاد هذا الاتفاق، يشكل كــل صك للتصديق على الاتفاقية أو لإقرارها رسميــا أو للانضمام إليها قبولا أيضا للالتزام بهذا الاتفاق.

2. No State or entity may establish its consent to be bound by this Agreement unless it has previously established or establishes at the same time its consent to be bound by the Convention.
٢ - لا يجوز ﻷي دولة أو كيان اثبات قبوله الالتــزام بهذا الاتفاق ما لم يكن اثبت قبل ذلك، أو ما لم يثبت في الوقت ذاته، قبوله الالتزام بالاتفاقية.

ويبدأ الفريق العامل المنشأ بموجب هذا الاتفاق العمل في غضون ٣٠ يوما من تاريخ بدء النفاذ.

2. In cases where an international organization referred to in Annex IX, article 1, of the Convention has competence over all the matters governed by this Agreement, the following provisions shall apply to participation by such international organization in this Agreement:
٢ - في الحالات التي تكون فيها لمنظمة دولية مشار إليها في المادة ١ من المرفق التاسع للاتفاقية اختصاصات فيما يتعلق بجميع المسائل التي ينظمها هذا الاتفاق، تنطبق اﻷحكام التالية على اشتراك تلك المنظمة الدولية في هذا الاتفاق:

1. The undersigned military commanders shall confirm to UNPROFOR the issuance of orders required by this Agreement, and their acknowledgment by subordinate commanders.
١ - على القادة العسكريين الموقعين أدناه أن يؤكدوا لقوة اﻷمم المتحدة للحماية إصدار اﻷوامر التي ينص عليها هذا الاتفاق وإقرار القادة التابعين لهم بتلقي هذه اﻷوامر.
