4.9 As to the author's allegation of a lack of independence or impartiality of the Saskatchewan Human Rights Tribunal " judge " in the Carlson test case, the State party submits that the author has not provided any evidence to support his allegation.
4-9 وبخصوص ادعاء صاحب البلاغ أن " قاضي " محكمة حقوق الإنسان بساسكاتشيوان المكلف بقضية كارلسون لم يتحل بالاستقلال أو النزاهة، تفيد الدولة الطرف بأن صاحب البلاغ لم يقدم أي أدلة لدعم هذا الادعاء.

The author's allegation remained general at best and he did not provide any evidence which would suggest that the Tribunal was influenced by personal bias, harboured preconceptions about the Carlson test case; that it acted in a way that promoted the interests of one of the parties over another; or that the Tribunal appeared to a reasonable observer to be partial.
وقد ظل ادعاء صاحب البلاغ عاماً في أفضل الأحوال كما أنه لم يقدم أي دليل يوحي بأن المحكمة قد تأثرت بآراء شخصية متحيزة واستندت إلى مفاهيم مسبقة بشأن قضية كارلسون أو أنها تصرفت على نحو خدم مصالح طرف على حساب الطرف الآخر؛ أو أنها بدت متحيزة في رأي مراقب عاقل.

6.6 The author did not object to delay the resolution of his case until the outcome in the Carlson test case despite the SHRC assessment that a final resolution was not to be expected before a considerable period of time.
6-6 ولم يعترض صاحب البلاغ على تأخير تسوية قضيته ريثما يُبتّ في قضية كارلسون رغم اعتقاد لجنة حقوق الإنسان بساسكاتشيوان أن التسوية النهائية ستأخذ وقتاً طويلاً.

3.4 According to the author, the undue delay and the unfair judgement in the Carlson test case renders the remedy before the Saskatchewan Human Rights Commission ineffective, thus violating article 2, paragraph 3, of the Covenant.
3-4 ويفيد صاحب البلاغ بأن التأخير المفرط والقرار غير المنصف الصادر في قضية كارلسون يجعلان الانتصاف أمام لجنة حقوق الإنسان بساسكاتشيوان عديم الفعالية، وهو ما يشكل انتهاكاً للفقرة 3 من المادة 2 من العهد.

3.7 Finally, the author submits that in the Carlson test case before the Saskatchewan Human Rights Tribunal, " the judge " appears to have been greatly influenced by the desires of the Canadian Union of Public Employees and the University of Regina to save money in connection with human rights cases.
3-7 وأخيراً، يفيد صاحب البلاغ بأن " القاضي " المكلّف بقضية كارلسون أمام محكمة حقوق الإنسان بساسكاتشيوان قد تأثر إلى حد كبير فيما يبدو برغبة النقابة الكندية للموظفين الحكوميين وجامعة ريجينا في الاقتصاد في الإنفاق المتصل بقضايا حقوق الإنسان.

The State party argues that the author was aware of the significant legal hurdles to cross, in particular the age definition in the Saskatchewan Human Rights Code, the Supreme Court case " McKinney " , and the dependency of his case on the outcome of the Carlson test case.
وتدّعي الدولة الطرف أن صاحب البلاغ كان على وعي بالعقبات القانونية الكأداء الواجب تخطيها، لا سيما تعريف السن في مدونة حقوق الإنسان لساسكاتشيوان، وبقضية " مكيني " أمام المحكمة العليا، وباعتماد قضيته على نتيجة قضية كارلسون.

5.2 The author reiterates that the optimism of a timely decision in the Carlson test case as conveyed by the SHRC and the estimation of the costs of using the regular Canadian Court system prevented him from filing a complaint under the regular court system.
5-2 ويكرر صاحب البلاغ أن ما أوحت إليه به لجنة حقوق الإنسان بساسكاتشيوان من تفاؤل بصدور قرار سريع في قضية كارلسون وتقدير تكاليف اللجوء إلى النظام القضائي الكندي العادي أمران حالا دون تقديمه شكوى إلى النظام القضائي العادي.
