٧- وفي ضوء ما سبق، يقرر الفريق العامل ما يلي: )أ( يعلن أن احتجاز أتيلاي أيسين وإيرين كسكين وأكبر كايا هو احتجاز تعسفي ﻷنه يتعارض مع المادتين ٩١ و٠٢ من اﻹعلان العالمي لحقوق اﻹنسان، ويندرج في إطار الفئة الثانية من المبادئ الواجبة التطبيق عند النظر في الحالات المعروضة على الفريق العامل.

(a) The detention of Hassan Ali Fadhel, Issa Saleh Issa and Ahmad Abdulla Fadhel is declared to be arbitrary being in contravention of articles 19 and 20 of the Universal Declaration of Human Rights and falling within category II of the principles applicable in the consideration of the cases submitted to the Working Group.
١١- وفي ضوء ما سبق، يقرر الفريق العامل ما يلي: )أ( أن احتجاز حسن علي فاضل وعيسى صالح عيسى وأحمد عبد الله فاضل هو احتجاز تعسفي لكونه يتعارض مع المادتين ٩١ و٠٢ من الاعلان العالمي لحقوق اﻹنسان ويندرج في إطار الفئة الثانية من المبادئ المنطبقة عند النظر في الحالات المقدمة إلى الفريق العامل.

(a) The detention of Tri Agus Susanto Siswowihardjo is declared to be arbitrary being in contravention of article 19 of the Universal Declaration of Human Rights and falling within category II of the principles applicable in the consideration of the cases submitted to the Working Group;
)أ( إن احتجاز تري آغوس سوسانتو سيسؤويهارجو هو احتجاز تعسفي مخالف ﻷحكام المادة ٩١ من الاعلان العالمي لحقوق اﻹنسان ويندرج في الفئة الثانية من المبادئ المنطبقة عند النظر في القضايا المعروضة على الفريق العامل؛

(a) Considers that the detention of Xue Deyun (alias Ma Zhe) is arbitrary as it contravenes article 19 of the Universal Declaration of Human Rights and falls within category II of the principles applicable in the consideration of the cases submitted to the Working Group;
(أ) يعتبر أن اعتقال شوي ديون (المعروف بما جي) هو اعتقال تعسفي يُخل بأحكام المادة 19 من الإعلان العالمي لحقوق الإنسان ويندرج في الفئة الثانية من المبادئ الواجبة التطبيق لدى النظر في الحالات المعروضة على الفريق العامل؛

Membership of the militant Oromo minority in Ethiopia was one of the reasons for a case of deprivation of freedom, which the Working Group deemed arbitrary under category II of the principles applied in assessing the arbitrary nature of cases of deprivation of liberty (opinion 5/1998).
وكان الانتساب إلى عضوية أقلية الأورومو المناضلة في إثيوبيا سبباً من أسباب الحرمان من الحرية الذي وجه الفريق العامل أنه تعسفي في إطار الفئة الثانية من المبادئ المطبقة في تقدير الطابع التعسفي لحالات الحرمان من الحرية (الرأي رقم 5/1998).

The detention of Mr. Habibullah, Mr. Khan Mohammad, Mr. Rafiq Ahmad Naeem, Mrs. Farida Rahat, Mrs. Sheikh Muhammad Aslam and Mrs. Amtullah Sallam, is declared to be arbitrary being in contravention of article 18 of the Universal Declaration of Human Rights and falling within category II of the principles applicable in the consideration of the cases submitted to the Working Group.
٦- وفي ضوء ما سبق يقرر الفريق العامل ما يلي: يعلن أن احتجاز السيد حبيب الله، والسيد خان محمد، والسيد رفيق أحمد نعيم، والسيدة فريدة رحات والسيدة شيخ محمد إسلام، والسيدة امتله سلام، هو احتجاز تعسفي ﻷنه يتعارض مع المادة ٨١ من اﻹعلان العالمي لحقوق اﻹنسان ويندرج في إطار الفئة الثانية من المبادئ الواجبة التطبيق عند النظر في الحالات المعروضة على الفريق العامل.

(a) The detention of Ali-Akbar Saidi-Sirjani and of Said Niazi Karmani is declared to be arbitrary being in contravention of article 19 of the Universal Declaration of Human Rights and article 19 of the International Covenant on Civil and Political Rights, to which the Islamic Republic of Iran is a party, and falling within category II of the principles applicable in the consideration of the cases submitted to the Working Group.
