The Statute of the Foreign Service of Uruguay treats staff in category M as a single group and does not distinguish between them by class or grade.
ويعامل النظام الأساسي للسلك الدبلوماسي لأوروغواي الموظفين من الفئة ميم كمجموعة واحدة ولا يفرق بينهم على أساس الدرجة أو الرتبة.

The State party adds that the author of the first communication had the chance, between being notified of his removal from category M and being reassigned to category R, to take the examination for the post of counsellor but did not receive a high enough mark to qualify for promotion.

The author informed the Committee that article 33 of Act No. 18.179 of 27 December 2010, which had set the maximum age limit for all category M posts in the Foreign Service at 70 years, was not applied to his case.
أبلغ صاحب البلاغ اللجنة أن المادة 33 من قانون 18-179 الصادر بتاريخ 27 كانون الأول/ديسمبر 2010، والذي يُحدد السن القصوى لجميع الوظائف من الفئة ميم في الخدمة في الخارجية هو 70 سنة، لم تُطبق في حالته.

Article 246 of Act No. 16.170, on the other hand, gives preference to four classes within category M (counsellor, minister-counsellor, minister and ambassador), who can continue in their diplomatic duties until the age of 70, while secretaries are relieved of these duties at the age of 60.
ومن جهة أخرى، تعطي المادة 246 من القانون رقم 16170 أفضلية لأربعة درجات داخل الفئة ميم (مستشار، ووزير - مستشار، ووزير، وسفير) يستمرون في مزاولة عملهم الدبلوماسي حتى سن السبعين، في حين يُعفى العاملون بدرجة سكرتير من هذه الواجبات في سن الستين.

Article 333 of this Act replaces article 20 of Act No. 14.206, as amended by article 246 of Act No. 16.170, with the following: " Article 20. The maximum age limit for the exercise of duties in category M in the Foreign Service is hereby set at 70 years.
وتحل المادة 333 من هذا القانون محل المادة 20 من القانون رقم 14206، بالصيغة التي عدلت بها بموجب المادة 246 من القانون رقم 16170: " المادة 20: الحد الأقصى لسن مزاولة أعمال الفئة ميم في السلك الدبلوماسي هو 70 سنة بموجب هذا القانون.

In the case at hand, the Committee observed that the State party had not explained the purpose of the distinction established by law between secretaries and other category M civil servants of the Foreign Service which led to the authors' cessation of duties, nor had it put forward reasonable and objective criteria for such a distinction.
وفي القضية المعروضة على اللجنة، لاحظت اللجنة أن الدولة الطرف لم تشرح الغرض من التفرقة بين العاملين بدرجة سكرتير وغيرهم من موظفي السلك الدبلوماسي من الفئة " ميم " ، والتي أدت إلى إنهاء خدمة أصحاب البلاغ، كما لم تقدم معايير معقولة وموضوعية لمثل هذه التفرقة.

The Committee took the view that, while the imposition of a compulsory retirement age for a particular occupation does not per se constitute discrimination on the ground of age, in the case at hand that age differs for secretaries and for other category M civil servants, a distinction which has not been justified by the State party.
ورأت اللجنة أنه إن كان فرض سن تقاعد إلزامية على فئة مهنية بعينها لا يشكل في حد ذاته أساساً للتمييز بسبب السن، فإن السن في القضية المعروضة على اللجنة تختلف فيما يتعلق بالعاملين بدرجة سكرتير وغيرهم من موظفي الفئة " ميم " ، وهي تفرقة لم تعللها الدولة الطرف.

11. The Committee takes note of the information provided by the authors to the effect that article 246 of Act No. 16.170 has been amended by article 333 of Act No. 18.719 of 27 December 2010, which has set the maximum age limit for all category M posts in the Foreign Service at 70 years and has provided for compensation for loss of earnings for the civil servants adversely affected by the now repealed article 246.
11- وتحيط اللجنة علماً بالمعلومات التي قدمها أصحاب البلاغ والتي تفيد بأن المادة 246 من القانون رقم 16170 عدلت بالمادة 333 من القانون رقم 18719 المؤرخ 27 كانون الأول/ديسمبر 2010 التي حددت السن القصوى لجميع مناصب الفئة ميم في السلك الدبلوماسي ﺑ70 سنة ونصت على التعويض عن فقدان الكسب الذي يتكبده الموظفون المدنيون الذين تأثروا سلباً بالمادة 246 الملغاة.

Those civil servants who, on the date of entry into force of the present Act, hold category R positions within the Ministry of Foreign Affairs in application of the age limit established under the provision previously in force (article 246 of Act No. 16.170) shall be automatically reappointed to the category M posts they previously occupied, for all purposes.
ويعاد بصورة تلقائية تعيين الموظفين المدنيين الذين يشغلون، وقت دخول هذا القانون حيز النفاذ، وظائف الفئة فاء في وزارة الخارجية تطبيقاً للحد الأقصى للسن المنصوص عليه في إطار القاعدة التي كانت سارية المفعول سابقاً (المادة 246 من القانون رقم 16170) في مناصب الفئة ميم التي كانوا يشغلونها سابقاً، لجميع الأغراض.
