4. Unless otherwise indicated, pre-trial and other procedural functions conferred under this Statute on the Court may be exercised by the Presidency in any case where a Chamber of the Court is not seized of the matter.

Another aspect to be emphasized is that in the case concerning the Frontier Dispute (Benin/Niger), the parties decided to submit it to a Chamber of the Court rather than to the plenary Court.

If a Chamber of the Court determines that conduct covered by article 71 also constitutes one of the offences defined in article 70, the Chamber shall proceed in accordance with article 70 and rules 6.26 to 6.36.

(ب) إذا علمت دائرة المحكمة قبل جلسة الاستماع أو في أثنائها بوجود أي طرف ثالث حسن النية يبدو أن له اهتماما بالعائدات أو الأموال أو الأصول ذات الصلة، يجوز لها أن تخطر هذا الطرف الثالث بالمثول.

(b) If before or during the hearing, a Chamber of the Court becomes aware of any bona fide third party who appears to have an interest in relevant proceeds, property or assets, it may give notice to that third party.
)ب( إذا علمت دائرة المحكمة قبل جلسة الاستماع أو في أثنائها بوجود أي طرف ثالث حسن النية يبدو أن له اهتماما بالعائدات أو اﻷموال أو اﻷصول ذات الصلة، يجوز لها أن تخطر هذا الطرف الثالث بالمثول.

(c) The person in custody before the Court shall have the right to raise matters concerning the conditions of his or her detention with the relevant Chamber of the Court.
)ج( للشخص المتحفظ عليه أمام المحكمة الحق في أن يثير أمام دائرة المحكمة ذات الصلة المسائل المتعلقة بشروط احتجازه.

3. A victim whose written application has been rejected by a Chamber of the Court under paragraph 2 of this Rule, may file a new application at a later stage in the proceedings.
٣ - يجوز للمجني عليه الذي رفضت دائرة المحكمة بموجب الفقرة ٢ من هذه المادة طلبه المكتوب أن يتقدم بطلب جديد في مرحلة لاحقة من مراحل اﻹجراءات.

(b) Having regard to rule 6.1 (d), the Court shall treat other communications as privileged under the same terms as subparagraphs (i) and (ii) of paragraph (a), if a Chamber of the Court decides that:
