In spite of the lack of an explicit provision excluding the criminalization and penalization of child victims of the offences covered by the Optional Protocol, the issue of avoiding the criminalization and double victimization of child victims is among the most common concerns raised by the Committee in the dialogue with States parties.

25. In spite of the lack of an explicit provision excluding the criminalization and penalization of child victims of the offences covered by the Optional Protocol, the issue of avoiding the criminalization and double victimization of child victims is among the most common concerns raised by the Committee in the dialogue with States parties.

(30) The Committee urges the State party to take all possible measures to avoid stigmatization and social marginalization of child victims of the offences covered by the Optional Protocol and make the necessary legislative amendments to ensure that these children are neither criminalized nor penalized.
30) تحث اللجنة الدولة الطرف على اتخاذ جميع التدابير الممكنة لتلافي وصم الأطفال ضحايا الجرائم المشمولة بالبروتوكول وتهميشهم اجتماعياً، وعلى إجراء جميع التعديلات التشريعية اللازمة لضمان عدم تجريم هؤلاء الأطفال ولا معاقبتهم.

(d) Guarantee that all child victims of the offences covered under the Optional Protocol have access to adequate procedures to seek, without discrimination, compensation for damages from those legally responsible, in accordance with article 9, paragraph 4, of the Optional Protocol;

39. While noting the efforts made to protect the rights of child victims of the offences covered by the Optional Protocol, the Committee is concerned that child victims of the offences under the Optional Protocol may not always be considered and treated in practice as victims as provided for in article 8 of the Optional Protocol and that little is done to avoid the marginalization and stigmatization of child victims.

(b) Provide access to shelters for child victims of the offences covered by the Protocol and ensure that children are separated from adults and that the staff of such shelters is provided with appropriate training, in particular legal and psychological training, in accordance with article 8, paragraph 4, of the Optional Protocol; and
