The Nationality Law of the People's Republic of China, enacted by the Chinese Government in September 1980, sets clear conditions for the acquisition, restoration and renunciation of Chinese nationality and stipulates that the Chinese Government does not recognize dual nationality for any Chinese national.

According to the Nationality Law of the People's Republic of China, except for the provision that state officials and military personnel on active service shall not renounce Chinese nationality, men and women citizens who are eligible, as well as their children, are equally entitled to acquire, renounce or restore Chinese nationality.

But a person whose parents are both Chinese nationals and have both settled abroad, or one of whose parents is a Chinese national and has settled abroad, and who has acquired foreign nationality at birth shall not have Chinese nationality " ; moreover, " any person born in China whose parents are stateless or of uncertain nationality and have settled in China shall have Chinese nationality " .

127. On 1 July 1997, the Chinese nationality (Miscellaneous Provisions) Ordinance (Cap 540) was enacted to provide for matters relating to the operation in the HKSAR of the Nationality Law of PRC (the " CNL " ) and the " Explanations of some questions by the Standing Committee of the National People's Congress concerning the implementation of the CNL in the HKSAR (the " NPCSC's Explanations " ).
