Recalling that the Convention sets out the right of victims to know the truth regarding the circumstances of the enforced disappearance, the progress and results of the investigation and the fate of the disappeared person, and sets forth State party obligations to take appropriate measures in this regard,

While recognizing that the criminal legislation of the State party provides for the transmission of general information on procedural matters to the family of the victims, the Committee remains concerned that the victims' right to know the truth regarding the circumstances of the enforced disappearance is not explicitly granted in French law.
وإذ تسلم اللجنة بأن التشريعات الجنائية للدولة الطرف تنص على تزويد أسر الضحايا بمعلومات عامة حول المسائل الإجرائية، فإنها تظل قلقة من أن حق الضحايا في معرفة الحقيقة بشأن ظروف الاختفاء القسري غير مكفول صراحة في القانون الفرنسي.

177. With regard to mechanisms guaranteeing the right to know the truth about the circumstances of the enforced disappearance and the fate of the disappeared person, it should be pointed out that all judicial proceedings are public, which means that the judgements pronounced may be freely accessed.
177- ومن جهة أخرى، وبخصوص الآليات التي تكفل الحق في معرفة حقيقة ظروف الاختفاء القسري ومصير الشخص المختفي، تجدر الإشارة إلى أن أي إجراء قضائي يعتبر إجراءاً علنياً، وبالتالي فالأحكام الصادرة في هذا الشأن تكون علنية.

The right to have access to the files of the case and to be informed of the progress of the procedure is still not provided for in the case of a victim who is not represented by a lawyer and, more generally, the right to know the truth regarding the circumstances of the enforced disappearance are not explicitly provided for under French law as required by article 24, paragraph 2, of the Convention.
ولا يزال الحق في الاطلاع على ملفات القضية وفي معرفة التقدم المحرز في الإجراءات غير متاح في حالة ضحية لا يمثله محامٍ وكذلك، بصفة أعم، لا ينص القانون الفرنسي بصراحة على الحق في معرفة الحقيقة فيما يتعلق بظروف الاختفاء القسري على نحو ما تقتضيه الفقرة 2 من المادة 24 من الاتفاقية.
