(د) يمتنع عن عمليات النقل غير المرخَّص بها لأي ذخيرة عنقودية أو ذخيرة فرعية من مناطق مشمولة بولايته أو خاضعة لسيطرته؛

5. During a period of deferred compliance pursuant to paragraph 3 of this Article, a High Contracting Party shall not transfer any cluster munition or submunition, other than those described in Technical Annex B, unless the recipient State agrees to:
5- يمتنع الطرف المتعاقد السامي أثناء فترة تأجيل الامتثال عملاً بالفقرة 3 من هذه المادة عن نقل أي ذخيرة عنقودية أو ذخيرة فرعية غير تلك المبينة في المرفق التقني باء، إلا إذا وافقت الدولة المتلقية على ما يلي:

A High Contracting Party that has deferred compliance with the prohibition of transfer, pursuant to paragraph 2 of this Article, shall, during the period of deferral, not transfer any cluster munition or submunition other than those described in paragraph 2 of the Technical Annex, unless the recipient State agrees to:
4- يمتنع الطرف المتعاقد السامي الذي يؤجل تطبيق حظر النقل عملاً بالفقرة 2 من هذه المادة، أثناء فترة التأجيل، عن نقل أي ذخيرة عنقودية أو ذخيرة فرعية غير تلك الموصوفة في الفقرة 2 من المرفق التقني، إلا إذا وافقت الدولة المتلقية على ما يلي:

9. A High Contracting Party that has deferred compliance with the prohibition of transfer, pursuant to paragraph 6 of this article, shall, during the period of deferral, not transfer any cluster munition or submunition other than those described in Technical annex B, unless the recipient State agrees to:
9- يمتنع الطرف المتعاقد السامي الذي يؤجل الامتثال لحظر النقل عملاً بالفقرة 6 من هذه المادة، أثناء فترة التأجيل، عن نقل أي ذخيرة عنقودية أو ذخيرة فرعية غير تلك الموصوفة في المرفق التقني باء، إلا إذا وافقت الدولة المتلقية على ما يلي:

A High Contracting Party that has deferred compliance with the prohibition of transfer, pursuant to paragraph 2 of this article, shall, during the period of deferral, not transfer any cluster munition or submunition that does not meet the requirements of paragraph 2 of article 4, unless the recipient State agrees to:
4- يمتنع الطرف المتعاقد السامي الذي يؤجل تطبيق حظر النقل عملاً بالفقرة 2 من هذه المادة، أثناء فترة التأجيل، عن نقل أي ذخيرة عنقودية أو ذخيرة فرعية لا تستوفي شروط الفقرة 2 من المادة 4، إلا إذا وافقت الدولة المتلقية على ما يلي:

A High Contracting Party that has deferred the application of paragraph 1 shall, during the period of deferral, not transfer any cluster munition or submunition that does not meet the requirements of Article 4 (2), unless the recipient State agrees to apply this Protocol with respect to the transferred items.
4- يمتنع الطرف المتعاقد السامي الذي يؤجل تطبيق الفقرة 1، خلال فترة التأجيل، عن نقل أية ذخيرة عنقودية أو ذخيرة فرعية لا تستوفي شروط المادة 4(2)، إلا أن توافق الدولة المتلقية على تطبيق هذا البروتوكول فيما يتعلق بالمواد المنقولة.

4. A High Contracting Party that has deferred the application of paragraph 1 shall, during the period of deferral, not transfer any cluster munition or submunition that does not meet the requirements of Article 4 (2), unless the recipient State agrees to apply this Protocol with respect to the transferred items.
4- يمتنع الطرف المتعاقد السامي الذي يؤجل تطبيق الفقرة 1، خلال فترة التأجيل، عن نقل أية ذخيرة عنقودية أو ذخيرة فرعية لا تستوفي شروط المادة 4(2)، إلا إذا وافقت الدولة المتلقية على تطبيق هذا البروتوكول فيما يتعلق بالمواد المنقولة.
