548 - والشرط المحدد الوحيد للزوجين في إطار الزواج العرفي، بغض النظر عن نوع الجنس، لاكتساب الحق في الإعالة والحق في الممتلكات المشتركة بعد فسخ زواجهما العرفي، هو استمرار الزواج العرفي مدة طويلة.

572. Otherwise, the common-law marriage with an underage person is qualified as a criminal offence by the Criminal Code of the Republic of Serbia (Art. 115).

535 - وكما سبق الذكر، يساوي قانون الزواج (المادة 16) بين الزواج العرفي والزواج القانوني فيما يتعلق بالحق في الإعالة المتبادلة بين الزوجين في إطار الزواج العرفي وغيره من العلاقات القانونية للملكية.

This implies that according to the provisions of the Law (Articles 293 to 297), it is the duty of the common-law spouses to support each other and that either one of them has the right to receive support from the other spouse if the common-law marriage has terminated.
وهذا يعني أنه بموجب أحكام القانون (المواد من 293 إلى 297) يكون واجب الزوجين في إطار الزواج العرفي إعالة أحدهما الآخر، وأن لكل منهما الحق في تلقي الإعالة من الزوج الآخر إذا انتهى الزواج العرفي.

Thus, parents can exercise all the rights and duties from the scope of parental right even after they cease cohabitation (in marriage or common-law marriage) and thus make an additional effort to avoid hostility and discontent with the court decision awarding exercise of the right to only one of them.
وهكذا يمكن للوالدين أن يمارسا جميع الحقوق والواجبات من منظور حقوق الوالدين حتى بعد أن يتوقفا عن المساكنة (في حالة الزواج أو الزواج العرفي) ومن ثم يقومان بجهود إضافية لتجنب الشعور العدائي والسخط إزاء قرار المحكمة بإعطاء حق ممارسة هذا الحق لواحد منهما فقط.

The Family Law recognizes only maintenance and property-legal effects of common-law marriage, which means that a union of longer duration between a man and a woman (common-law marriage) is rendered equal with marriage with regard to the right to mutual support and other property-legal relations, if there are no obstacles for a valid marriage (Article 12).
ويعترف قانون الأسرة بالمحافظة فقط على آثار الزواج العرفي والآثار القانونية المتعلقة بالملكية، وهو ما يعني أن اتحاداً طويل الأجل بين رجل وامرأة (زواج عرفي) يصبح مساوياً للزواج فيما يتعلق بالإعالة المتبادلة وغير ذلك من العلاقات القانونية المرتبطة بالملكية، إذا لم تكن هناك عقبات تحول دون قيام زواج صحيح (المادة 12).

407. Under our law, a union of longer duration between a man and a woman (common-law marriage) is rendered equal with marriage with regard to the right to mutual support and other property-legal relations (Article 12, Family Law).
407- وبموجب قوانينا، يعتبر أي اتحاد بين رجل وامرأة (زواج عرفي) يدوم لفترة طويلة مكافئاً للزواج من حيث الحق في الإعالة المشتركة وعلاقات الملكية القانونية الأخرى (المادة 12 من قانون الأسرة).
