(د) إن كانت الدولة الطرف قد رفضت، منذ دخول البروتوكول حيز النفاذ، أي طلب لتسليم شخص يخضع لولايتها القضائية تتهمه دولة أخرى بأي من الجرائم الوارد ذكرها في هذا البروتوكول، وفي هذه الحالة، ينبغي ذكر سبب رفض التسليم، وما إن كان الشخص المعني قد تمت إحالته إلى السلطات المختصة في الدولة الطرف لمحاكمته؛

(b) If extradition is conditional on the existence of an extradition treaty in force for the State party and a requesting State, whether the competent authorities of the State party recognize article 5, paragraph 2, as sufficient basis for granting an extradition request made by another party to this Protocol, including in cases in which the extradition request concerns a national of the State receiving the request;
(ب) إذا كان التسليم مشروطاً بوجود معاهدة نافذة لتسليم المجرمين بالنسبة إلى الدولة الطرف والدولة طالبة التسليم، وما إذا كانت السلطات المختصة في الدولة الطرف تعترف بالفقرة 2 من المادة 5 كأساس كاف للموافقة على طلب التسليم المقدم من دولة طرف في هذا البروتوكول، بما في ذلك الحالات التي يكون فيها طلب التسليم متعلقاً بأحد مواطني الدولة المتلقية للطلب؛
