Convention No. 143, 1975, concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers;

ILO Convention No. 143 of 1975 concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers provides that a migrant who has resided legally in the territory for the purpose of employment shall not be regarded as in an irregular situation by the mere fact of the loss of his employment.

25. Convention (No. 143) concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers

This provision echoes article 9, paragraph 1, of ILO Convention No. 143 (1975) concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers (Supplementary Provisions).

16. The Committee notes that the State party has still not acceded to International Labour Organization (ILO) Convention No. 97 (1949) concerning Migration for Employment, or to Convention No. 143 (1975), concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.
16- وتحيط اللجنة علماً بأن الدولة الطرف لم تنضم بعد إلى اتفاقية منظمة العمل الدولية رقم 97 بشأن العمال المهاجرين، لعام 1949، ولا إلى الاتفاقية رقم 143 بشأن الهجرة في أوضاع اعتسافية وتعزيز تكافؤ الفرص والمعاملة للعمال المهاجرين، لعام 1975.

2. CMW invited Bolivia to accede to ILO Conventions No. 97 (1949) concerning Migration for Employment and No. 143 (1975) concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.

11. The Committee notes that the State party has not ratified ILO Conventions No. 97 (revised 1949) concerning Migration for Employment or No. 143 (1975) concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.
11- وتلاحظ اللجنة أن الدولة الطرف لم تصدق على اتفاقيتي منظمة العمل الدولية رقم 97 (مراجعة عام 1949) بشأن العمال المهاجرين أو رقم 143(1975) بشأن الهجرة في أوضاع تعسفية وتعزيز تكافؤ الفرص والمعاملة للعمال المهاجرين.

It further recommends that the State party ratify the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families and ILO Convention No. 143 (1975) concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.
وتوصي اللجنة كذلك الدولة الطرف بأن تُصدِّق على الاتفاقية الدولية لحماية حقوق جميع العمال المهاجرين وأفراد أُسرهم، واتفاقية منظمة العمل الدولية رقم 143(1975) بشأن الهجرة في أوضاع اعتسافية وتعزيز تكافؤ الفرص والمعاملة للعمال المهاجرين.

3. CESCR urged Mauritius to ratify ILO Convention No. 143 concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.
3- وحثت اللجنة المعنية بالحقوق الاقتصادية والاجتماعية والثقافية موريشيوس على التصديق على اتفاقية منظمة العمل الدولية رقم 143 بشأن الهجرة في ظروف تعسفية وتشجيع تكافؤ الفرص والمساواة في معاملة العمال المهاجرين(9).

8. The Committee notes that the State party has not yet become a party to ILO Conventions No. 97 (revised, 1949) concerning migration for employment, No. 143 (1975) concerning Migrations in abusive conditions and the promotion of equality of opportunity and treatment of migrant workers and No. 189 (2011) concerning decent work for domestic workers.

3. In 2010, the Special Rapporteur on the human rights of migrants recommended that the Government consider ratifying the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (ICRMW) and ILO Convention No. 143 concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.

The 1984 recommendations also referred to the 1975 International Labour Organization (ILO) Convention concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers (No. 143),3 adopted just after the adoption of the World Population Plan.
وأحالت توصيات عام ١٩٨٤ أيضا الى اتفاقية منظمة العمل الدولية لعام ١٩٧٥ المتعلقة بالهجرة في ظروف مهينة وبتشجيع المساواة في إتاحة الفرص للعمال المهاجرين وفي معاملتهم )رقم ١٤٣()٣(، التي اعتمدت فور اعتماد خطة العمل العالمية للسكان.

2. In 2010, the Committee on the Protection of the Rights of All Migrant Workers and Members of Their Families (CMW) recommended that the Government consider making the declarations provided for in articles 76 and 77 of the Convention and ratify International Labour Organization (ILO) Convention No. 143 concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.

Togo had ratified International Labour Organization (ILO) Convention No. 143 (Convention concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers)3. Article 23 of the Constitution provided that aliens could be expelled or extradited only upon the decision of a competent judicial authority.
وكانت توغو قد صدقت على اتفاقية منظمة العمل الدولية رقم 143 (الاتفاقية المتعلقة بالهجرة في ظروف مهينة وتشجيع المساواة بين العمال المهاجرين)().وتنص المادة 23 من الاتفاقية على أنه لا يمكن طرد أو تسليم الأجانب إلا بموجب قرار صادر عن السلطة القضائية المختصة.

Two of its conventions on international migrants, namely, the Convention concerning Migration for Employment (Revised), 1949 (No. 97), and the Convention concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment for Migrant Workers, 1975 (No. 143), are in force.

In addition, ILO has adopted two international conventions on the rights of migrant workers, namely, the Convention concerning Migration for Employment (Revised), 1949 (No. 97), and the Convention concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers, 1975 (No. 143), both of which are in force.

Two key instruments of the International Labour Organization (ILO) for the protection of migrant workers, namely, the Convention concerning Migration for Employment (Revised 1949) (No. 97), and the Convention concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers, 1975 (No. 143), have been in force for a long time.
