On this record, I cannot join the views of the Committee concerning the application of Article 9, namely, the Committee's conclusion that the detention of the authors was per se " arbitrary " and " unlawful " within the meaning of article 9 (1) and 9 (4) of the Covenant.

3- وللتغلب على التحديات المتعلقة بتطبيق المادة 9 من الاتفاقية، اتُفق في قمة كارتاخينا على أن الدول الأطراف التي لم تضع تدابير وطنية للتنفيذ مدعوة لأن تضع وتعتمد، على وجه الاستعجال، تدابير تشريعية وإدارية وغير ذلك من التدابير تمشياً مع المادة 9 من أجل الوفاء بالتزاماتها بموجب هذه المادة ومن ثم الإسهام في الامتثال التام للاتفاقية.

119.
