In these circumstances the Working group believes that the detention of the above-mentioned persons is in contravention of articles 9 and 10 of the Universal Declaration of Human Rights, relating respectively to the right not to be arbitrarily detained and the right to a fair trial, and that the contravention is of such gravity as to confer on the deprivation of liberty an arbitrary character.

This constitutes a violation of articles 9 and 10 of the Universal Declaration of Human Rights and of principles 10, 11, 12, 13, 15, 16, 17, 18, 19 and 33 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment which is of such gravity as to confer on the deprivation of liberty an arbitrary character.

If the Working Group is to find the detention arbitrary, it must establish that the court's total or partial failure to respect international standards on the right to a fair trial was of such gravity as to confer on the deprivation of liberty an arbitrary character.

20. In this respect and in conformity with its methods of work, the Working Group considers that, under article 14, paragraph 1, of the Covenant, if a trial is not conducted by a competent, independent and impartial tribunal, the gravity of the violation of the right to a fair trial is such as to confer on the deprivation of liberty an arbitrary character.
20- ويرى الفريق العامل في هذا الخصوص، ووفقاً لأساليب العمل التي يتبعها، أن الفقرة 1 من المادة 14 من العهد تقضي بأنه إذا لم تُجر أي محاكمة من جانب محكمة مختصة ومستقلة ونزيهة، فإن خطورة انتهاك الحق في الحصول على محاكمة عادلة تضفي على الحرمان من الحرية طابعاً تعسفياً.

III. When the complete or partial non—observance of the relevant international standards set forth in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned relating to the right to a fair trial is of such gravity as to confer on the deprivation of liberty, of whatever kind, an arbitrary character (Category III).
ثالثاً- عندما يصل عدم الامتثال الجزئي أو الكلي للمعايير الدولية ذات الصلة، المحددة في اﻹعلان العالمي لحقوق اﻹنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية والمتعلقة بالحق في محاكمة عادلة، إلى درجة من الخطورة تضفي على الحرمان من الحرية، أيّا كان نوعه، طابعا تعسفياً )الفئة الثالثة(.

When the complete or partial nonobservance of the international standards relating to a fair trial set forth in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned is of such gravity as to confer on the deprivation of liberty, of whatever kind, an arbitrary character (category III).
`3` حين يكون التجاهل التام أو الجزئي للمعايير الدولية المتعلقة بالمحاكمة العادلة المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي المواثيق الدولية الأخرى التي قبلت بها الحكومات المعنية - من الخطورة لدرجة تضفي على الحرمان من الحرية، أياً كان نوعه، طبيعة تعسفية (الفئة 3).

`٣` عندما يصل عدم الامتثال، الجزئي أو الكلي، للمعايير الدولية المتصلة بالحق في محاكمة عادلة، المحددة في اﻹعلان العالمي لحقوق اﻹنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، إلى درجة من الخطورة تضفي على الحرمان من الحرية، أيﱠاً كان نوعه، طابعاً تعسفياً )الفئة الثالثة(.

These irregularities, however, though they undoubtedly constitute violations of internal rules of procedure, cannot, in the light of the Working Group's methods of work, constitute a violation of such gravity as to confer on the deprivation of liberty an arbitrary character.
ولكن لا يمكن، في ضوء أساليب عمل الفريق العامل اعتبار هذه المخالفات الإجرائية، حتى وإن كانت تشكل، بلا ريب، انتهاكاً لأصول المحاكمات المحلية، انتهاكاً من الخطورة بحيث يضفي على عملية الحرمان من الحرية طابعاً تعسفياً.
