Like torture, rape is a violation of personal dignity, and rape in fact constitutes torture when it is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity. " 84

6.5 The author claims that the fact that he has spent 21 years seeking recognition of the injury inflicted on him by the State party and that, as a result of his most recent arrest, which took place in front of his family, he spent six months in prison in deplorable conditions, lost his job and was unable to visit his seriously-ill father, constitutes torture and consequently entails a violation of article 7 of the Covenant.

On 3 November 2006, the complainant transmitted to the Committee a note from Mr. Khawaja Mohammad Asif, a member of the National Assembly of Pakistan, stating that, if the complainant returned to Pakistan he would be arrested and imprisoned for political reasons because of an offence that he had not committed, and that conditions of detention in Pakistani prisons are such that imprisonment constitutes torture or at least inhuman treatment.
