In cases of gross violations of international human rights law and serious violations of international humanitarian law constituting crimes under international law, States have the duty to investigate and, if there is sufficient evidence, the duty to submit to prosecution the person allegedly responsible for the violations and, if found guilty, the duty to punish her or him.
4 - في حالات الانتهاكات الجسيمة للقانون الدولي لحقوق الإنسان والانتهاكات الخطيرة للقانون الإنساني الدولي التي تشكل جرائم بموجب القانون الدولي، يقع على الدول واجب التحقيق فيها وواجب محاكمة الشخص الذي يزعم أنه مسؤول عن هذه الانتهاكات في حال توافر أدلة كافية ضده، وواجب معاقبته في حالة إدانته.

4 - في حالات الانتهاكات الجسيمة لقانون حقوق الإنسان الدولي والانتهاكات الخطيرة للقانون الإنساني الدولي التي تشكل جرائم بموجب القانون الدولي، يقع على الدول واجب التحقيق فيها وواجب محاكمة الأشخاص الذين يُزعم أنهم ارتكبوا هذه الانتهاكات في حال توفر أدلة كافية ضدهم، وواجب إنزال العقوبة بالجناة في حال إدانتهم.

26. The following amendment to the first sentence of principle 4 was proposed (changes indicated in italics): " In cases of gross violation of international human rights law and serious violations of international humanitarian law constituting crimes under international law, States have the duty to investigate ... " .
26- واقتُرِح إدخال التعديل التالي على الجملة الأولى من المبدأ 4 (كُتبت التغييرات بخط مائل): " في حالات الانتهاك الجسيم لقانون حقوق الإنسان الدولي والانتهاكات الخطيرة للقانون الإنساني الدولي التي تشكل جرائم بموجب القانون الدولي، يقع على الدول واجب التحقيق.... " .
