This right was affirmed in treaties, agreements and other constructive arrangements between States and indigenous peoples and in international law, and in the decisions and recommendations of international and regional human rights bodies.

The experts also note that treaties, agreements and other constructive arrangements between States and indigenous peoples have not been respected, leading to loss of lands, resources and rights, and that non-implementation threatens indigenous peoples' survival as distinct peoples.

2. The seminar on treaties, agreements and other constructive arrangements between States and indigenous peoples was held at the United Nations Office at Geneva, from 15 to 17 December 2003.

38. Reference was also made to the recent United Nations Seminar on Treaties, Agreements and Other constructive arrangements between States and indigenous peoples, held in Geneva from 15 to 17 December 2003.
38 - وأوردت إشارة أيضا إلى حلقة الأمم المتحدة الدراسية الأخيرة المعنية بالمعاهدات والاتفاقات وغيرها من الترتيبات البناءة المبرمة بين الدول والشعوب الأصلية التي عُقدت في جنيف في الفترة من 15 إلى 17 كانون الأول/ديسمبر 2003.

(f) To authorize the publication by the Office of the United Nations High Commissioner for Human Rights of the study on treaties, agreements and other constructive arrangements between States and indigenous peoples in a consolidated version in all official languages and including the recommendations of the present seminar;
(و) الإذن بأن تنشر مفوضية حقوق الإنسان الدراسة الخاصة بالمعاهدات والاتفاقات وغيرها من الترتيبات البناءة المبرمة بين الدول والشعوب الأصلية بصيغة موحدة بجميع اللغات الرسمية تتضمن توصيات هذه الحلقة الدراسية؛

(g) To recommend that the United Nations library receive, catalogue and publish an inventory of materials relating to treaties and agreements, including materials submitted to the Special Rapporteur on treaties, agreements and other constructive arrangements between States and indigenous peoples.

13. Ms. Sandra Ginnish (Canada) presented the Government of Canada's document entitled " Perspectives on treaties, agreements and other constructive arrangements between States and indigenous peoples " .

38. A seminar was proposed on possible ways and means of ensuring the implementation of treaties, agreements and other constructive arrangements between States and indigenous peoples and the adjudication of disputes that remained unresolved by existing conflict-resolution mechanisms.
38- واقتُرح عقد حلقة دراسية عن الطرق والوسائل التي يمكن أن تكفل تنفيذ المعاهدات والاتفاقات وغيرها من الترتيبات البناءة بين الدول والشعوب الأصلية والفصل في النـزاعات التي لم تسو بعد بواسطة الآليات القائمة لتسوية المنازعات.

54. The report on the second seminar on treaties, agreements and other constructive arrangements between States and indigenous peoples (A/HRC/EMRIP/2010/5), and recommendations contained therein was presented by OHCHR and the co-Rapporteurs of the seminar, Wilton Littlechild and Andrea Carmen in light of its relevance for the implementation of article 37 and other pertinent provisions of the Declaration.
