وينص الإعلان في المادة 37 على أن " للشعوب الأصلية الحق في الاعتراف بالمعاهدات والاتفاقات وغير ذلك من الترتيبات البناءة المبرمة مع الدول أو مع ما يخلفها من دول ومراعاتها وإعمالها، وفي جعل الدول تنفذ وتحترم هذه المعاهدات والاتفاقات وغيرها من الترتيبات البناءة " .

In article 36, it establishes that “Indigenous peoples have the right to the recognition, observance and enforcement of treaties, agreements and other constructive arrangements concluded with States or their successors, according to their original spirit and intent, and to have States honour and respect such treaties, agreements and other constructive arrangements”.

42. In this connection, the draft declaration, in article 36, establishes that " Indigenous peoples have the right to the recognition, observance and enforcement of treaties, agreements and other constructive arrangements concluded with States or their successors, according to their original spirit and intent, and to have States honour and respect such treaties, agreements and other constructive arrangements.
42- وفي هذا الصدد، ينص مشروع الإعلان، في المادة 36 منه، على أن " للشعوب الأصلية الحق في الاعتراف بالمعاهدات والاتفاقات وغيرها من الترتيبات البناءة المبرمة مع الدول أو خلفائها وفي الالتزام بها وتنفيذها، وفقاً لروحها وغرضها الأصلي، وفي أن تعمل الدول على تنفيذ واحترام هذه المعاهدات والاتفاقات وغيرها من الترتيبات البناءة.

12. Experts call upon States to comply with their legal obligations under treaties, agreements and other constructive arrangements concluded between indigenous peoples and modern States or their predecessors and to implement the decisions and recommendations of international human rights bodies and special rapporteurs recognizing and upholding indigenous peoples' rights to their lands and resources.
12 - ويدعو الخبراء الدول إلى الوفاء بالتزاماتها القانونية المقررة بموجب المعاهدات والاتفاقات وغيرها من الترتيبات البناءة المبرمة بين الشعوب الأصلية والدول الحديثة أو الكيانات السلف، وإلى تنفيذ ما صدر عن الهيئات الدولية المعنية بحقوق الإنسان والمقررين الخاصين من قرارات وتوصيات تقر حق الشعوب الأصلية في أراضيها ومواردها وتسنده.

41. Experts called upon States to comply with their legal obligations under treaties, agreements and other constructive arrangements concluded between indigenous peoples and modern States or their predecessors, and to implement the decisions and recommendations of international human rights bodies and special rapporteurs recognizing and upholding indigenous peoples' rights to their lands and resources.
41- ودعا الخبراء الدول إلى احترام التزاماتها القانونية بموجب المعاهدات والاتفاقات وغير ذلك من الترتيبات البناءة المبرمة بين الشعوب الأصلية والدول الحديثة أو مع الدول التي خلفتها، وتنفيذ القرارات والتوصيات التي اتخذتها هيئات حقوق الإنسان الدولية والمقررون الخاصون والتي تعترف بحقوق الشعوب الأصلية في أراضيها ومواردها وتدعمها.
